A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAt1EIM
THAT PETITION FOR CONDITIONAL USE PERMIT N0. 1541 BE GRANTED.
WHEREAS, the City Planning Commission of thc City of Anaheim did receive a
verified Petition for Conditional Use Permit from MARY ALICE GRIMSHAW, 1112 S.
E1 Camino Lane, Santa Ana, Ca. 92705 (Gwner)• PACIFIC OUTDOOR ADVERTISING, ATTN:
JAY KIN6RY, 1740 Narva Street, Los Angeles, Ca. 90031 (Agent) of certain real
property situated in the City of Anaheim, County of Grange, State of California,
described as:
Town Lot No. 49, as per map recorded in Book 4, Pages 629 and 630 of Deeds, in
the office of the County Recorder of Los Angeles County, California; and
WHEREAS, the City Planning Commission d:a :chedule a public hearing at the
City Hall in the City af Anaheim on June 9, 1975, at 1;30 p.m., notice o` said
public hearing having been duly given as required by law and in accordance with
the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider
evidence for and against said proposed conditional use and to investigate and
make findings and recommendations in connection therewith; and
WHEREAS, said Commission, after due inspection, investigation and study made
by itself and in its behalf, and after due consideration of all evidence and
reports offered at said hearina, does find and determine the following facts:
1, Tfiat the proposed use is properly one for whict~ a conditional use permit
is authorized by Lode Section 18.45.~50.090, to wit: permit the continued use of
an existing billboard, with waivers of:
a. SECTION 18.05.111.021 - Permitted location, (Billboards not permitted
in the Centrel City Area)
b. SECTION 18.05._116.02C - Maximum heiqht within 300 feet of a residential
structure. (2 feet permitted; 6 feet existing)
2. That the Planning Commission her~~by determines that approval of the subject
conditional use permit shall be made subject to the conditions of approval of
Conditional Use Permit No. 1479 which was granted by the City Councii on July 8, 1974,
approving the billboard at subject locatioii for or.e year.
3, That the petitioner stipulated that, in the event the Cortxnunity Redevelopment
Agency expands the redevelopment project area to include s~bject property and acquires
the subject property for redevelopment, prior to the expiration of this conditional
use permit, all rights to severance damages for removal of the billboard are hereby
waived and that said stipulation will be submitted in writing by the owner(s) of the
biliboard prior to City Council review of the proposal.
4. That the proposed use, as granted, will not adversely affect the adjoining
land uses and the growth and development of the area in which it is proposed to be
located,
5. That the size and shape of the site proposed for the use, as granted, is
adeyuate to allow the full development of the proposed use in a manner not detrimental
ta the particular area nor to the peace, health, safety, and general welfare of the
Citizens of the City of Anaheim.
6. That the granting of the Conditicnal Use Permit under the conditions imposed,
if any, will ~iot be detrimental to the peace, health, safety, and general welfare of
the Citizens of the City of Anaheim.
7. That no one indicated their presence at said public hearing in opposition
and no correspondence was received in opposition to subject petition.
ENVIRONMENTAL IMPAGT REPORT FINDING:
That the Director of the Development Services Department has determined that the
proposed activity fatls within the definition of Section 3.01, Class 1, of the City of
Hnaheim Guidelines to the Requirements for an EIR and is, therefore, categorically
exempt from the requirement to file an EIR.

NOW, THEREFOkE, BE IT RESOLVED that the Anaheim City Planning Cemnission does
hereby grant subject Petition for Co~iditianal Use Permit, upon the following
conditions which are hereby found to be a necessary prerequisite to the proposed
use of the subject property in order to preserve the safety and general welfare af
the Citizens of the City of Anaheim:
1. That the subject property shall be developed substantially in accordance
with plans and specifications on file with the City of Anaheim marked Exhibit No. 1,
7.. .That this conditional use permit is granted for a period of o~e (1) year,
to expire on June 9, 1976, at which time the billboard shall be removed from the
subject property.
3. That the aFplicant is hereby granted permission to illuminate said billboard
for the one (1) year period that said billboard is permitted to exist,
4, That, in the event the Community Redevelopment Agency acquires the subject
property for redevelopment, prior to expiration of this conditional use permit, all
rights to severance damages for removal of the biliboard are hereby waived, as
stipulated to by the petitioner; and, further, the foregoing stipulation shall be
submitted in writing prior to City Council review of the proposal.
