A RESOLUTIO~! OF THE CITY PLANNING COMMISSION OF "fHE CITY OF ANAHEIM
RECOMMENDING TO THE CITY COUNCIL OF TH~ CITY OF ANAHEIM THAT
PETITION fOR RECLASSIFICATION N0. 74-75-40 BE APPROVED.
WHEREAS, the City Planning Commission of the City of Anaheim did receive a
verified Petition for Reclassification from TEXACR/ANAHEIM HILLS, INC., 380 Anaheim
Hi11s~Road, Anaheim, Cali~Fornia 92807 ~~ne;); ANAHEIM HILLS, INC., 380 Anaheim
Hills Road, Anaheim, California 92807 (Agent.j of certain real property situated in
the City of Anaheim, County of Orange, State af California, described as:
That portion of Section 12, Township 4 South, Range 9 West, in the Rancho Santiago
de Santa Ana, being also a portion of the land allotted to Paula Peralta de
Dominguez, as described in the fir.;,7 dec~ee of partition of the Rancho Santiago
de Santa Ana, which was entered Septemher 12, 1868 in Book "B", page 410 of Judg-
ments of the Cistrict Court of the 17th Judicial District in and for Los Angeles
County, California, described as follows: •
Parcel i as shc~n on a Map filed in Book 57, pages 6 and 7 of Parcel Maps, records
of Orange County, California; and
WHEREAS, the City Plannina~ Commission did hold a public hearing at the City
Hall in the City of Anaheim on April 28, 1975, at 1:30 p.m., notice of said public
hearing having been dul'y c~iven as required by law and in accordance with the
provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider
evidence for and against sa.id proposed reclassification and to ,investigate and
make findings and recar~mendations in connection therewith; and
WHEREAS, said Commission, after due inspection, investigation and study made
by itself and in ies behalf, a.-~d after due consideration of all evidence and
reports offered at said hearing, does find and determine the following facts:
l. That the petitioner nroposes reclassification of the above-described
property from the RS-A-43,OU~KS'~) (RESIDENTIAL/AGRICULTURAL - SCENIC CORRIDOR
OVERLAY) ZONE *_o the CO(SC)~ ~,COMMERCIAL, OFFICE AND PROFESSIQNAL - SCENIC
CORRIDOR OVERLkY) ~!ONE.
2. That the Anaheim G~neral Plan, as amended, desig~~ates subJect property
for medium de:nsity resider~t'fa1 uses, although commercia'I uses are desig~ated for
the properties to the north a4ross Canyon Rim Road and to xhe west across Nohl
Ranch Road.
3. That the proposed reclassification of subJect prmperty is necessary and/or
desirable for the orderly and proper developma~it of the community.
4. That the proposed reclassification of subJect property does properly
relate to the zones and their permitted uses locally established in close proxinity
to subject property and to the zones and their permitted uses ~enerally established
throughout the community.
5. That the petitioner stipulated that the proposed structures would be
constructed with Spanish tile roofs.
6. That the Plar-~ing Commission does hereby determine that a left-turn
pocket to facilitate left turns into the prnposed employee parking lot off Nohl
Ranch Road shall be provided in accordance with a design approved by the City
Engineer; otherwise, no left turns shall be allowed into said parking lot.
7, That no one indicated their presence at said public hearing in opposition,
and no corresponde~ce was received in opposition to subject petition. .
ENVIRONMENTAL IMPACT REPORT FIhDING:
That the Planning Commission recommends to the City Council that the subJect
project be exempt from the requiremen2 to prepare an environmental impact report,
pursuant *_o the provisions of the Cattfornia Environmental Quality Act.

NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission
does hereby recommend to the City Council of the City of Anaheim that subject
P~tition for Reclassification be approved an~, by so doing, that Title 18-Zoning
of the Anaheim Municipal Code be amended to exclude the above-described property
from the RS-A-43,000(SC) (RESIDENTIAL/AGRICULTURAL - SCENIC CORRIDOR OVERLAY)
Z~NE and to incorporate said described property into the CO(SC) {C011MERCIAL,
OFFICE AND PROFESSIONAL - SCENIC CORRIDOR OVERLAY) ZONE upon the following
cond~tions which are hereby found to be a necessary prerequisite to the proposed
use of subject property in order to preserve the safety and 9eneral welfare of
the Citizens of the City of Anaheim:
1. That trash storage areas shall be provided in accordance with approved
plans on file with the Office of the Director of Public Wot'ks.
2. That fire hydra~ts sholl be installed and charged as required and
determined to be necessary by the Chief of the Fire Department prior to commence-
ment of structural framing.
3. That subject property shall be served by unde:~rowid utilities.
4. That drainage of said property shall be disposed of in a manner satis-
factory to the City Engineer. If, in the preparation of the site sufficient
grading is required to necessitate a grading permit, no work on grading wil~ be
permitted bet~aeen October 15th and April 15th unless all required off-sit~
drainage facilities have been installed and are operative. Positive assurance
shall be provided the City that such drainage facilities will be cempleted prior
to October 15th. Necessary right-of-way for off-site drainage facilities shall
be dedicated to the City, or the City Council shall have initiated condemnation
proceedings therefor (ttie costs of which shall be borne by the developer) prior
to the commencement of grading operations. The required drainage facilities
shall be of a size and type sufficient to carry runoff waters originating from
higher properties through said property to ultimat~ disposal as approved by the
City Engineer. Said drainage facilities shall be che first item of construction
and shall be completed and be functional throughout the subJect tract and from
the downstream boundary of the property to the ultimate point of disposal prior
to the issuance of any final building inspections or occupancy permits. Drainage
district reimbursement egreements may be made availabie to the developers of
said property upon their request.
5. That grading, excavatio~, and all other construction activities shall
be conducted in such a marmer so a~ :o minimi~e the possibility of any silt
originating from this project being carried into the Santa Ana River by storm
water originating from or flo~+ing through this project.
6. That ap;~ropria:e water assessment fees, as determined by the Director
of Public Utilities, shall be paid to the Ci~y of Anaheim prior to the issuanr,e
of a bu'slding permit.
7„ That street iighting facilities along Nohl Ranch Road shall be installed
as re uired b the Director of Public Utilities, and in accordance with sta~dard
plansQand specifications on file in the Office of the Director o` public Utilities
and that a bond in an amount and form satisfactory to the City of Anaheim shall be
posted with the City to guarantee the installation of the above-mentioned
requi rernents.
8. That subject property shall be developed substantially in accordance
with plans and specifications on file with the City of Anaheim marked Exhibit
Nos. 1 and 2; provided, however, that the proposed structures shall be constri.icted
with Spanish tile roofs, as stipulated to by the petitioner, and that no left
turns shall be allowed into the proposed employee parking lot off Nohl Fanch Road
unless a left-turn pocket to facilitate lefe turns shall be provided i~ accordance
with a design approved by the City Ergineer.
9. Prior to [he introduction of an ordinance rezoning subject property,
Condition No. 7, above-mentioned, shall be completed. The provisions or rights
granted by this resolution shall become null and void by action of the City Council
unless said conditions are complied with within one year from the date hcreof, or
such further time as the City Council may grant.
10. That Condition dos. 1, ~, 4, 5 and 8, above-mentioned, shall be complied
with prior to final building and zoning inspections.
