public hearing having been duly given as required by law and in accordance with
the provisions of the Anaheim Ttunicipal Code, Chapter 18.03. to hear and consider
evidence for and against said proposed conditional use and to investigate and
make findings and recooanendations in connection therewith; and

by itsel£ and in its behalf~ and after due consideration of all evidence and
reports offered at said hearing, does find and determine the foliowing facts:
1. That the proposed use is properly one :`or which a conditioaal use permit is
authorized by Code Section 18.44.05U.010, to wit: perc~it on-sale 6eez in an
existing billiard room.
2. That the petitioner stipulated the primary use is for a billiard room and
not a beer bar and, therefore. no stools for scatin~ purposes sliall be provided at
the service counter.
3. Thut the petitioner stipulated there ~aill be n~ cool:inp, on the premises, biit
ttiat sandwiche~ will be prepared and sold.
~f. That the proposed ~ise will not adversely offect the adjoinin~ ltind uses an:i
the growth and development of the area in which it is proposed to be loc~ted.
5. That the size and ahape of ttie site proposed for the use is adequate to axlow
the full development of the propoaed use in u manner not detri~ental to the ~r-rticu!ar
area nor to Che peace, health, safety, and genernl welfare of the Ci''zens of the City
of Anaheim.
6. That the granting of the Conditional Uae Permit under th2 conditions imposed,
if any, will not be detrimenCal to the peace, health, safety, and ~eneral welfaze of
the Citizens of the City of Anaheim.

no correspondence wae; received in opposition to subject petition.

therefore~ categor,ic~lly exempt from the requiremt~,~ to file an LIR.
NOW, TtiF.REF6RE. BG IT RESOLVED that Chc Anaheim City Planning Commission doe~
hereby grant subject Petitlon for Condition~l Use Permit, upon the following ccnditions
which are herehY found to be a necessary o=e.requisite ta the proposed use oE the
.:ubject property in order to preserve the s~fety and general welfare of the Citizens
of thc City of Anaheim: •
1. That the sub~ect property ahall be developeJ aubetantially in accordance with
platts and specifications on file vith the City of Anaheim marked Exhibit Nos. 1 and 2.
2. That the primary use of the subject proFertp shall be for a billiard room and

counter (bar), as stipulated to by the petitioner.
3. That there shall be no cooking on the premises, as stipulated to by the
