by itself and in its behal,E, and after due consideration of all evidence and
reports offered at said hearin~, does finl and determine the following facts:
1. That the petitioner requests the follotaing waiver from the Anaheim
Tfunicipal Code, to expand an existing Veterans or Foreign Wars buil~iing:
SECTION 18.61.063.012 -:iinirum front setback. (25 feet required; £i feet
propose~l)
2. That the above-mentloned waiver is hereby ~ranted on the basis tliat the
proposal is to expand an existing building and a liardship woulcl be created if sail
waiver were not granted.
3. That there are excepti~r.al or extraordinary circumstances or conditions
applicable to the property involved or to the intended use of the property that do
not apply generally Co the property or class of use in the same vicinity and zone.
4. That the requested variance is necessary for the preservation and enjoyr.ient
of a substantial property right possessed by other property in the same vicinity
and zone, and denied to the property in question.
5. That the requested variance will not be naterially detrimental to the pllhlic
welfare or injurious to the property or improvements in such viciniCy and zone in
which the property is located.
6. That no one indicated their presence at said public hearin~ in opposition,
and no correspondence was received in opposition to sub~ect petition.
~NVIRONDfENTAL IMPACT REPORT FINDING:
That the Director of the Development Services Department has determined that the
proposed activity falls within the definition of Section 3.01, Class 3, o£ tl~e City
of Anaheim Guidelines to the Requirements for an Envir.onmental Impact Report and,is,
ther.efore, categarically exempt from the requirement to file an EIR.
NOS1, TFiERLFORB, BE IT RGSOLVED that the Anaheim City Planning Coromission does
hereby grant subject Petition for Variance, upon the followins conditions which are
hereby found to be a necessary prerequisite to the proposed use of the suh~ect property
in order to preserve the ~afety and general welfare of the Citizens of the City of

1. That subject property shall be developed substantially in ar,cordance witl~
plans and specifications on file with the City of Anaheim marlced Exhibit ~Ios. 1, 7,
and 3.
