in the City of Anahein on July 7, 1975, at 1:30 p.m., notice of said public hearin~
hsvin~ Ueen duly given as required by law and in accordance with the provisions of.
the Anaheim I•Iunicipal Code, Cltapter 1?i.03, to hear and consider evidence for and
against said proposed variance and to investi~ate and nalce findings and
recommendaiions in connection therewith; and
W}ii3REAS, said Commission, after due inspection, investigation and study ma:le by
itself and in its behalf, and after due consideration of all evidence and reports
offered at said hearing, does find and determine the follocaing facts:
1. That the petitioner requests the fallowing waiver from the Anahei~n :4unicipal
Code, to permit a house addition:
S~CTION 18.26.063.030 - Minimum rear vard setback. (1~ feet requireci;
E feeL-, 6 inches proposed)
2, That the above-mentioned waiver is hereby granterl on the basis that the
request is minimal.
3. That approval of this variance shall be sub~ec:t to compliance ~?ith the
minimum standards of the adopted Buildin~ Codes of the City of Anaheim.
!~. .That there are exceptional or er.traordinar.y circumstances or conclitions
appl3cable to the property involved or to the intended use of the pr.operty that do
not apPly ~enerally to the property or class of use in Che•same vicinity and zone.
5. That the requested vartance is necessary for the preservation and enjoyment
of a substantial property ri~ht possessed by otlier property in the same vicinity and
zonP, and clenied to the property in question.
6. That the requested variance will not be materially detrtmental to the puhlic
welfare or in3urious ~o the property or improve!uents in sucii vicinity and zone in
which the property is located.
7. That no one indicated their presence at saicl public hearing in opposition;
and no correspondence was received in opposition Co subject petition.

That the Director of the Development Services Department has determined that the
proposed activity falls wlthin the definition of Section 3.01, Class 5, of the CiCy
of Anaheim Guidelines to the Requirements for an environmental iMpact report and is,
tlierefore, caCegorically exempt from the requirement to file an EIR.
t:Ol•1, THEREFORE, 11E IT RESOLVED that the Anaheim City Planning Commission does
t~ereby grant subject Petition for Variance, upon Che followin~ conditions which are
hereby found to be a necessary prerequisite to the propased use of the sub~ect
properCy in order to preserve the safety and general welfare of the Citizens of the
City of Anaheim:
