WHEREAS, the City Planning Commission did hold a public hearing at the City
Hall in the City of Anaheim on July 7, 1975~ at 1:3Q p.m.~ notice of said public
hearing having been duly given as required by law and in accordance with the provisions
of the Anaheim Municip.31 Code, Chapter 18.Q3, Co hear and consider evidence for and
against said proposed v.iriance and to investigate and make findings and recommendatians
in connectiuu therewith; and
WIIETtEl~S, said CommisRion, after due inspection, investigation and study made by
itself and in its beiialf, and after due consideration of all e~idence and reports
offered at said hearing~ does find and determine the following facts:
1. 'fhat the petitioner requests the following waiver from the Anaheim ~Iunicipal
Code, to pernit five (S) f1aFs acid one (1) banner:
SECTIOiJ 18.05.080 - Permitted signs. (Fla~s and banners not permitted)
2. That the above-mentioned waiver is hereby granted for a period o£ time
conaisting of eight (8) consecutive weekends and any legal holidays occurring durinB
that period; said pe:iod co:~mencing on this date and eacpiring Aug~lst 31~ 1975; followinQ
vhich time the petitioner stipulated to submittittg a, written report for Planning Commission
and/or City Council review, said report to indicate the benefits derived from the usa~e of
the flags and banners.
3~ That there are exceptional or extraordinary circumstances or conditions applicable
to the property involved or to the itttended use of tt~e property tliat do not apply p,eneraJ.ly
to the property or class of use in the same vicinity and zone.
!~. Tliat the requested variance is necessary for the preseYVation and enjoyment' of a
subatantial property right possessed by other property in the :ame vicinity ancl zone, and
denied to the property in question.
5. Tliat the requested variance will not be materially detrimenta.l to tlie public
welfare or injurfous to the property or improvements in such vicinity and zone in which
the prnperty ie located.
6. That no one indicated their presence at said public hearin~ in opposition; and
no correspondence was received in opposition to sub~ect petition.

prop~sed activity falla witliin the definition of Section 3.01, Class 11, of the City oE
Analieim Guidelines to the Requiremente for an Environmentnl Impact Report and is. there-
fore, categorically exempt from the requirement to file an EIR.
NCId, THEREFORE, SiE IT RFSOLVED that the 9naheim City Planning Commission doea
hereby ~rant sub~ect Petition for Var,iance, upon the follawing conditions which are
hereby found to be a necessary prerequiaite to the proposed use of the sub~ect property
in order to preserve the saf:ty and general welfare of the Citizens of the City of
Anaheim:
