THAT PETITION FOR VARIANCE N0. 2723 BE DEtdIED.
WHEREAS, the City P'lanning Commission of the City of Anaheim did receive a
verified Petition for Variance from RA.Y^{OND G. SPEHAR, 913 Paloma Place, Fullerton,
California 92635 (Owner); CARL KARCH~R ENTERPRISES, INC., d.b.a. Carl~s Jr.
Restaurant, 1200 N. Harbor Boulevard, Anaheim, California 92801 (Agent) of certain
real property described as:
All that cer.tain land situated in the State of California, County of Orange, described
as follows:
That portion of allotments in decree of partition of the Rancho Canon de Santa Ana,
recorded in Case No. 1478 of the 17th Judicial DisCrict Court of California, a certi-
fied cony of which was recorded February 8, 1874 in book 28, page 158 of Deeds in the
office of the County Recorc~er of Los Angeles County, California, described as follows:
Parcel No. 3 as ehown on a Map filed in book 56, page 2 of Parcel Maps in the off.ice
of the County Recorder of Orange County, California.
GiHERF1S, the City Planning Commission did hold a public hearing at the City Hall
in the City of Anaheim on July 21, 1975, at 1:30 p.m., notice of said public hearing
having been duly given as required by law and in accordance with the provisions ~f
the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and
agaiiist said proposed variance and to investigate and make findings and
recommendations in connection therewith; and
T~IIIsR~AS, said Commission, after due inspection, investigation and study made by
itself and in its behalf, and after due consideration of all evidence and reports
offered at said hearir.g, doea find and determine the following facts:
1. That the petitioner requests the following waiver from the Anaheim Ptunicipal
Code, to permit four (4) wall signs in the "CL (SC)" COMM~RCIAL, LI.`tITED (SCENIC
CORRIDOR OVEKLAY) ZONE:
SECTION 18.05.091.020 - Permitted sign~. (1 wall sign permitted; 4 wall signs
proposed)
2. That the above-mentioned waiver ts hereby denied on the basis that the
petitioner did not demonstrate a hardship would be created if said waiver were not
granted, since the subject property is a corner parcel at an exceptionally busy
intersection; and, fi:rther, thaC the proposal would set an undesirable precedent for
future similar requests in the Scenic Corridor.
3. That there are no exceptional or extraordinary circumstances or condi.tions
applicable to the property involved or to the intended use of the property that do
not apply generally to the property or cl.ass of use in the same viciaity and zone.
4. That the requested variance is not necessary for the preservation and
enjoyment of a substantial property right possessed by other property in the same
~icinity and zone, and denied to the prope:ty in question.
5. That the requested variance will be materially detrimental to the public
welfare or in~urious to the property or improvements in such vicinity and zone in
which the property is located.
6. That no one indicated their presence at said public hearing in opposition;
and no correspondence was received in opposition to sub~ect petition.
ENVIRONMENTAL IMPACT REPORT FINDING:
That the Director of the Development Services Department hae determined that the
proposed activity falls within tke definition of Section 3.01, Claes 1~, of the City
of Anaheim Guidelines to the Requirements for an Environmental Impact Repoxt and is,
therefore, categorically exempt from the requirement to file an EIR.

NOW, THEREFURE, B~ IT RESOLVED that the Anaheim City Planning Commisaion does
hereby deny subject Petition £or Variance on the basis of the aforemenCioned
findings.
