1t7iEREAS, the City Planning Commission did hold a public hearing at the City
Hall in the City of Anahein on September 3, 1975, at 1:30 p.m., notice of said piiblic
hearing ]iaving been duly given as required by latio and in accordance with the
provisions o£ the Anaheim Diunicipal Code, Chapter 1R,03, to hear and consider
evidence for and against said proposed conditional use and to investigate and make
findings and recommendations in connection therewith; and
IVI-1F.REAS, said Commission, after due inspection, investigation and study made
by itself and in its behalf, and after due consideration of all evidence and reports
offered at saicl hearing, does find and determine the following facts:
1. That the Proposecl use is properly one for which a conditional use
permit is luthorized by Code Section 13.61.~50.390, to wit: permit on-sale bcer and
wine in an existirg restaurant in the ML (INDUSTR2AL, LIA1ITFD) ZO;VF...
2. That the on-sale beer and wine is proposecl in conjunction with the
serving of ineals.
3. That the proposed use will not adversely affect the adjoininq lancl uses
and the growth and development of the area in which it is proposed to be located.
4. That the size and shape of the site proposed for the iise is adequate to
allow the full development o£ the proposed use in a manner not detrimental to the
particular area nor to tne peace, health, safety, and general welfare of the Citizens
of tlie City of Anaheim.
5. T'hat the granting of the Conditional Use Permit under the conditions
imposed, if any, will not be detrimental to the peace, health, safety and general
welfare of tlie Citizens of the City of AnaheiF.
6. That no one indicated their presence at said public hearing in
opposition, and no corraspondence was received in opposition to subject petition.

That the Director of the Planninp, Dep~rtment hns cletermined that the
proposed activity falls within the definition of Section 3.~1, Class 1, of the City
of Anaheim Guidelines to the Requirements for an F.nvironmental Impact Report and is,
theref.ore, categoricaliy exempt from the requirenent to file 1n EIR.

does hereby grant subject Petition for Conditional Use Permit, upon the following
conelitions which are hereby found to be a necessary prer.equisite to the propos~d us~

Citizens of the City of Anahein:
