ROWLAND, 10~0 West La Palma Avenue, Anaheim, California 92801 (Agent) of certain real property descr.ibed as: The land referrecl to in this pol.icy is situated in the State of Cali£ornia, County of Orange, CiT.y of Anaheim, and is ciescriberi as follows: All of Tract No. 7035, as shotian on a Pdap recorcled in book 265, pages 1G and 11 of biiscellaneous ~iaps, records of Orange County, California. 1VIiF.RF.AS, the City Planning Commission ciid hold a puUlic h~ar.ing at the City Hall in tlie City of Anaheim on September 3, 1975, at 1:30 p.m., not:.ce of said piiblic hearing hlving been duly given as required by law and in accordan~e with the provisions of the Anaheim Dfunicipal Code, Chapter 1R.Q:i, to hear. and consider evidence for and against said proposed variance and to investigate and make f:indings and recommendations in connection therewith; and IV~iGREAS, said Commission, after due inspection, investigation and ~tiidy made Uy itself and in its behalf, ancl after diie consideration of. all evidence and reports of.fered at said hearing, does find and determine the following facts: 1. That the petitioner requests the followina waivers from the Anaheim Dfunicipal Code, to permit twelve (12) un'_awfiilly constructed apartments: (a) SfiCTION 18.34.061.010 - Minimt~m building site area per unit. (1,200 s iaare feet required; l,57. square eet existing (b) SECTION 18.3A.062.~32 - Atinimum floor area, (7(1Q square fcet required; 270 an~l 609 square feet existing) 2. That Waiver 1-a, above-mentioned, is herehy granted on the basis that tlie original approval of the subject apartment complex was for 24R dwelling tinits; however, only 24C dwelling •~mits ware actualiy constritcted and, with the conversion of the 12 tsvo-Uedroom tinits to two baclielor-type units each, there is a total of 252 units presentlv existing on the property, or foiir more i~nits than originally approved; and, therefore, the request is determined to be minimal for the subject property. 3. That Waiver 1-b, above-mentioned, was withdrawn by the peYitioner with the stipulation to reallocate the floor space af the 17. tmlawfiilly converted two- bedroom apartments so that each of the 24 resultant bachelor-type units will conform to the original approval of Conditional Use Permit No. 802 which permitted bachelor- type apartments varying in size from 420 to 6ft5 squlre £eet. 4. That the petitioner stipulated that the converted apartment imits will comply with the minimum standards of the City of Anaheim as adopted in the liniform Building, Plumbing, F.lectrical, Housing, Mechanical and Fire Codes, and that plans sliall be submitted, building perraits obtazned, and tlie work commenceci within 45 days from the date hereof, 5. That there are exceptional or extraordinary circumstances or conditions applicable to the property involved or to tlie intended use, as granted, of the property that ~tr? not apply generally to the property or class of use in the same vicinity and zone: 6. A That no one indicated their presence at said public hearing in oPposition; and no correspondence was received in opPosition to subject petition. EbIVIRO?P1Ei9TAL IPIPACT REPORT FINDING: That the Planning Commission does hereby recommend to the City Council that the stibject project be exempt from the requirement to prepare an environmental impact report, pursuant• to the provisions of the California Environmental Quality Act. NOW, TNF.RF.FORE, BF. IT RESOLVED that the Anaheim City Planning Commission does hereby grant, in part, subject Petition for Variance, upon the fnllowing conditions wliich are hereby foimd to be a necessar.y prerequisite to the proposed use o£ the subject property in order to preserve the safety anci general welfare of the Citizens of the City of Anaheim: 1. That subject property shall be develoPed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibit Nos. 1, 2, 3, 4, and 5; pravided, however, that the floor space of the 12 converted two- bedroom dweiling uni.ts shall be reallocateJ to result in 24 bachelor-tyPe dweiling units having minimum floor areas of 420 square feet. 2. That the existing structure shall be brought up to the minimwn standards of the City of Anaheim, including the Unif.orm Ruilding, Plumbing, F.lectricaY, }lousing, htechanical and Fire Codes as adopted by the City of Anaheim. 3, Plans shall be submitted to the Building Division shouing compliance with tlie minimum standards of the City of Anaheim, incliidinp, the Uniform Riiilding, Plumbing, F.lectrical, Housing, 6fechanical, and Fire Codes as adopted hy the City of Anlheim; and additionally, that appropriate permi~.~i shall be obtained and ths necessary work shall commence witliin 45 days from the date hereof. 9. That Condition Nos. 1 and 2, above-mentioned, sliall be complied with prior to final building and zoninp, inspections, or within a period of 18Q days from date hereof, whichever occurs first or such further time as the Plannning Commission or City Council may grant. 1975.
