public hearing having been duly given as rec7uired by ?aw and in accordance with the
provisions of the Anaheim Municipal Code, Ghapter 1R.03, to hear and consider
evidence for and agai.nst said proposed conditional. use and to irrvestigate and ma]ce
fiu~c3irx~s and recannen~ations in wnnection ther~wi.th; and

by itself and in its be~a].f, and a£ter due considesation o£ a].1 evi3ence anr~ reFx~rts
offered at said hearanc,r, cloes f.incl and det~smine the follc~~inq faets:
1. That the proposed use is pmper.ly one for which a conditional use
permit is authorizeci by Code Sections 14.61.Q5G.050 and 18.61.050.070, to ~rit:
permi~ an autambile auction and reconditioning facility in the NQ, (IfiDT?STR71~I„

2, That the proposea use is hereby cTranted on the h3sis that the
petitioner stipulated that the proposed use will be wnducked o~holly (100~) as a
wholesale operation with no retail sales; that only State o£ Calif.ornia licensecl
autarobile dealers who are also registesed with the subject establiskunent wi3.1 be
peanitted on the site in connection with the sale or purchase o£ autrnabiles; that
the reoonditioni.ng of autanobiles will be an accessory £unction cle,arly incidental to

3. That the petitionex stipulated that the proposed six (6) fmt high
cyclone-type fence will be entirely inteskrnren with reclwooci or ceciar s)ats, in
ca~liance vrith Caie requsements regardinq the enclos-~ire of outdoor uses.
4. That, inasmtch as approsimatQ..].y one-ha].f of the subject property is
currently undeveloped and vacant, ancl s:nce no structural changes are current].y beirxf
propos~l to the dweloped portian of the property which is to be utilizc-x~ for the
subject use at the present timer the Plvu-ing Ca~mission dces hereky determi.ne that
the petitioner sha7.1 not be required to ma}:e the engi.neering and street lighting
improvanents along Tustin Avenue adjacent to the undeveloped ~rtion of subject
property at this time, as v.~ould typically be required by the City; however, a trmd in
an amount anci fonn satisfaetory ta the City of Flnaheim shall he postec? with the City
to guarantee the installation of said improvenents at such ti~ne ab the vacant por'cion

5. That the petitioner stipulated to oam?lying with the P~[, site
developnent standards f.or signinq and, f.urther, pea.ti~ner indicated that only wall
signs are propased.

(2) That a bond in an amnunt and form satisfactory to the City of Anaheim
shall be posted with the City t~o guarantee the installation of. all engineering
rc~,;renents of the City of 1lnaheim along Tustin Avenue, incl~ui3.ng the Prevaration of
improvenent plans and the installation of. all improvemer.ts such as curbs and guttess,
siclewal.lcs, street c~-ading and paving, drainage £acilities, or otrer aprnirtesiant c,nrk
to be ca~lied with, as requ.ired ky the City Engineer and i-~ accordance with staridard
plans ancl specifications on file in the Off~.ce o£ i:he City Engineer; and, further. tA
yvarantee that street lighting facilities along Tustin Avenue shall be installecl as
requircxi by the Director of Public Utilit3.es and in accorci~nce with stanc~ar~3 plans
and specifications on file in the Office of the Director of Puhlic Utilities.
(3) That trash storage areas shall be provided in accordance with appraved
plans on f.ile with the Office of the Director of Pubiic Works.

detesminod to he necessar.y by the Chief of the k'ire D~'~artrnent prior to oam~~cene~t
of structural frami.ng.

satisfactory to the City Engi.neer.
