PC75-221 A RESOLUTION OF THE CiTY PLANNING COMMISSION OF THE CITY OF ANAHEIM THAT PETITION FOR VARIANCE N0. 2741 BE GRANTED WHEREAS, the City Planning Commission of the City of Anaheim did receive a verified Petition for Variance from ANTON J. AND MAf;IETTA M. RUPPANER, 1446 Lo ry Avenue, Anaheim, Califor~nia 92802 (Owners) of certain real property situated in the City of /lnaheim, County of Oranne, State of California, described as: Lot 1 of Tract No. 6774, as per map -ecorded in Book 253, Pages 44 and 45 of Miscellaneous Maps, records of said County. WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim on October 29: ~975, aY. 1:30 p.m., notice of said public hearing having baen duly given as required by law and in accordance with the provisions of the Anaheim Municip~~ Code, Chapter 18.03, to hear and consider evidence for and against said proposed var.iance and to investi9ate and make findings and recommendations in connectio~ therewith; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the foltowing facts: l. 7hat the petitioner requests the following waiver from the Anaheim Municipal Cade, to construct a house addition: SECTION 18.27.062.020 - Maximum covera e. t35$ permitted; 39.5~ proposed 2. That the above-mentioned waiver is hereby granted for a house addition not to exceed 233 square feet or 42~ maximum tot coverage, said approval being granted on the basis that, although the present Code specifies that the maximum lot coverage ?n the RS-500C Zone shall not exceed 35$ of the lot area for dwelling units with three bedrooms or less, the subject dwelling was constructed under Code require- ments specifying 40~ lot coverage and, therefore, the request is determined to be minimal; and. furtiierrtare, thaC similar requests have previously been 9ranted by the Planning Commission. 3. 7hat there are exceptional or ex2raordinary circumstances or conditions applicabte Co the property involved or to the intended use of the property that d~ not apply generally to the properCy ,~r class of use in the same vicinity and zone. 4. ,Ti~at the requested variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property i~ the same vicinity and zone, and denied to the property in question. 5. 7hat the requested variance will not be materially detrimental to the public welfare or injurious to the pro~~erty or improvements in such vicinity and zone in which the property is located. 6. That no one indicated their preeence at said public hearing in opposition; and no correspondence was received in apoosition to subject petition. E~IVIRONMENTAL IMPACT REPORT FINDItaG: That the Director of the Plarning Department has determined that the proposed activity falls within the dei'inition of Section 3.01, Class 1, of the City of Anaheim Guidelines to the Requirements for an Environmental Impact Report and is, therefore, categorically exempt from the requirement to file an EIR. IJOW, TNEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby grant subject Petition far Variance, upon the following conditions which are hereby found to be a necessary prerequisite to the proposed use of the subject property in order to preserve the safety and general weff~re of the Citizens of the City of Anaheim: RF.SOLUTIOPJ NU. That su5ject property shail be developed substantially in accordance with plans and specifications on file with the CiCy of Anaheim marked Exhibit Nos. 1 and 2; provided, however, that the proposed house addition shall be permitted to be a maximum of 233 square feet and shall not exceed 42$ maximum lot coverage. 2. That Condition No. 1, above-mentianed, shall be complied with prior to final building and zoning inspections.
