KELLY, Ace fireworks Company, Inc., 2025 Cedar Avenue, #2, Long Beach, California 90806 (Agent) of certain real property situated in tha City of Anaheim, Lounty of Orange, State ~f Calif~rnia, described as Lot No. 11 of Tract No. 5078 as per map recorded in book 188 pages 7 and 8 of Miscellaneous Maps, 'sn the office of the county recorder of said county; and WHEREL0.S, the City ~l.annang'Commission did hold a public hearing at the City Hall in the City of Aneheim on Feb ruary 3, ~ 975 , ai 1:30 o'clock P.M., notice af seid public hearing heving been duly given as cequited by law and ia accordunce with the provisions af the Anaheim Municipel code, Chapter 18,03~to heat and cortsidec evickence f,or and against said propased conditional use and to investigete and meke finding:; and recommendations in cor.nection tnerewith; erid WHEkEAS, si3id Commission, after due inspection, investigation, and study made by itsel[ and in its be- half, and efter due consideratian of all evidence and reports offered at said hearing, does find +~nd determinc :he following fects: 1. That the proposed use is properly one for which a Conditional Use Permit is authocized by Code Section 18.61.050, to wit: permit the storage of fireworks in the ML (INDUSTRIAL, LIGHT) "LONE. 2. That the proposed use is hereby denied or, the basis that approximately 6Q persons, consisting of property owner•s, residents, and employees in the immediate area, signed petitions (n opposition and, therefore, the proposal would be detrimental to the peace, health, safety and general o~el(are of those citizens; although City StafF provided in- formation indicating that the proposed use was compatible with industrial development. 3, That the proposed use will adversely arfect the adjoining land uses and the growth and development of the area in which it is proposed to be located, 4. That the size and shape of the site proposed for the use is n~t adequate to allow the full development of the proposed use in a manner not de~rimental to the particular area nor to tiie peace, health, safety, and general welfare of the Citizens of the City of Anaheim. 5. That the granting of the Condition Use Pe*mit. will be detr•imental to the peace, health, safety, and general welfare of the Citizens of the City of Anaheim. 6. That t.hree (3) persons appeared at said public hearing in opposit;un. ENVIRONMENTAL IMPAGT REPORT FINDING: That the Planning Commission recommends to the City Cnuncil that the subject project be exempt from the requirement to prepare an Environmental Impact Report pursuant to the provisions of the California Environmental Quality Act.
