A RE~OLUTION OF THE AIJAHEIM CITY PLANNING COMM~SSION FINDING AND
DETERMINING THAT TNE PROPOSED KIMBERLY STORM CHANNEL RECONSTRUCTION
IS IN CONFORM/~P1CE WITH THE Clir'S ADOPTED GENERAL PLAN AND THAT IT
CONCURS WITH AN EDIVIROtlMEIJTAL IMPACT NEGATIVE DECLARATiOM.
WHEREAS, the County of Orange Environmental Management Agency proposes to
reconstruct and enlarge Kimberly Storm Channel and acquire rights-of-way, from
Fullerton Creek Channel to 700 feet easterly of Raymond Avenue, to provide flood
relief for an important industrial area which experiences considerable distress
during even moderate storms; and
WfiEREAS, the Orange County Environmental Manao:ment Agency issued an
environmental im;~act nega*_ive declaration on September 19, 1975. for the proposed
~roject; and
Wt~EREAS, the Government Code of the °tate of California, Section 65402,
prr,vides, in part, that a local agency shall not acqutre real property nor dispose of
any real property, ~or construct a public building or structure in any county or
~l~y. until the location, purpose and extent of such activity has been reported upon
z.c to conformitp with the adopted general plan applicable thereto.
NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Cortmission
does hereby find and determine that the proposed acquisition and drainage
improvements identified as the Kimberly Storm Channel Reconstruction are in
conformity with the City of Anaheim~s adopted General Plan, and that satd Commission
concurs with the issuance of the environmental impact negative declaration in
connection with said proJect.
