A RESOLUTION OF TI~E CITY PLANPlING COMMISSION OF THE CITY OF ANAHEIM
THAT PETITIOPJ FOR COtlDITIONAL USE PERMIT N0. 1586 BE GRANTED.
WHEREAS, the City Planning Commission cf the City of Anaheim d;d receive
a verified Petition for Condttional Use Permit from WILLIAM E. BALLHAUS, 2500 Harbor
Boulevard., Fullerton, CA 92634 (Owner); ALFRED E. GIESE, 2134 N. Hathaway, Santa Ana,
CA 9z701 and GARY M. FUNK, 1228 S. Magnolia, Anaheim, CA 92802 (Ag~nts) of certain
rcal property situated in the City of Anahefm, County of Orange, State of California,
described as:
Parcel 1 as shown on a Parcel Map recorded in Book 29, page 45, of Parcel t1aps.
41HEREAS, the City Planning Commission did hold a public hearing at the City
Hall in the City of Anaheim on December 22, 1975, at 1:30 p.m., notice af said public
hearing having been duly given as required by law and in accordance with the provi-
sions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence
for and against said proposed conditional use and to investigate and make fi~dings
and recommendations in connection therewith; and ~
WHEREAS, said Commission, after due inspection, investigation and study
made by itself and in its behalf, and after due consideration of all evidence artd
reports offered at said hearing, does find and determine the following facts:
l. That the propos~d use is properly one for which a conditional use permit
is authorized by Code Sectior~ 18.44.050.010, to,wit: permit on-sale bee~• and wine
in an existing restaurant.
2. That the petitioner stipulateu the on-sale beer and wine will be in con-
junction with the serving of ineals only.
~3. That the petitioner stipulated the hours of operation will be from 9:00 a.m.
to 10:00 p.m., seven days a week.
' 4. That the proposed use will not adversely affect the adjoining land uses
an~ che growth and development of the area in which it is proposed to be located.
5. That the size ~nd shape of the site proposed for the use is adequate to
aliow the full development of the proposed use in a manner ~iot detrimental to the
particular area nor to the peace, health, safety, and general welfare of the Citizens
of the City of Anaheim.
6. That the granttng of the Conditional Use Permlt under the conditions
imposed, if any, will not be detrimental to the peace, health~ safety. and general
welfare of the Citizens of the City of Anahetm.
7. That no one indicated their presence at said publfc hearing in opposition;
and no correspondence was received in opposition to subJect petition.
ENVIRCNMENTAL IMPACT REPORT FINDING:
That the Director of the Planning Department has determtned that the proposed
activity falls within the definition of Section 3•O1, Class l, of the City of Anaheim
Guidelines to the Requirements for an Environmental Impact Report and is, therefore~
ca:egorically exempt from the requirement to file an EIR.
NOW. THEREFORE, BE IT RESOLVEU that the Anaheim City Planning Commission
does hereby grant subject Petitlon for Condltional Use Permit, upon the follcwing
conditions which are hereby found to be a necessary prerequtsite to the proposed use
of the subject pcoperty in order to preserve the safety and general weifare of the
Citizens ofi the City of Anaheim:
(1) That subJect property shall be developed substantlally in accordance
with plans and specifications on file with the City of Anaheim marY,ed Exhibit
Nos. 1 ;snd 2.
~2) That the on-sale beer and wine shall be in conjunction with the serving
of ineals only, as stipulated to by the petitioner.

saven days a week, as stipulated to by the petitioner.
