A RESOLUTION OF THE CITY PLANNING C~MMISSION OF'I'HE CITY OF ANAHEIM
THAT PET1TlON FOR VARIANCE N0. z670 I3E GRANTED IN PART
WHEREAS, the City Planning Commission of the City of Anaheim did receive a verified Petition for V;i~=ance from GgORGE

ENGINEERING COMPAAIY, P. 0. Box 3668, Anaheim, California 92803 (Agent) of certain renl
properCy situated in the City of Anaheim, County of Orange, State of Califurnia, descr~.bed
as being a portion of the south half of the southeast quarter of Section 2, Township 4
South, Range 10 West, in the Rancho San Juan Ca~on de Santa Ana, as shown on a map recoxded
in Book 51, Paga 10 of MisceZlaneous Maps,.in the office of the County Recorder of said
County, and more particularly described as follows: Begi.ming at a point on the south line

WHEREAS, the City Planning Commission did hold a public hearing at lhe City Hall in thc City of Anahcim on
February 19 , 1975, at 1: 30 o clock p.m., notice of said public liexring having bee~: duly given as rcquircd by law and
in accordance wiUi the provisions of the Maheim Municipal Code, Chapter 18. 03to hear and consider evidence for and against said
proposed variance and to in~estigate and make findings and recommendations in connection therewith; an:
WHEREAS, said Commission, after due inspection, investigation, and study made by itsclf and in its bchalf, and after duc
consideration o(all evidence and reports offered at said hearing, does find and determine the following facts~
i. That the pctitioner requests the following waivers from the Anaheim Mun3cipal ~ode, to
construct a 250-unit condominium developmant:
a. SECTYON 18.31.062.012 - Idaximum b~iilding height. (1-stor required; 2 staries
propased)
b. SECTION 18.31.063.011 - Minimum front setback. (20 feet required; 10 feet
proposed)
2. That Waiver 1-a, a'~ove-mentioned, is hereby granted in purt, waiving the maximum
building height ad~acent ~o the RS-A-43,000 zoned property only.
3. That Waiver 1-b, above-mentionad, is hereby denied on the basia that becauae of
the size of tha property, no hardahip could be demonstrated.
4. That there are exceptional or extraordinary circumatancea or conditions applicable
to the proper*y involved or to the intended use, as granCed, of the properCy that do not
apply generally to the property or clase of use in the eame vicinity and zone.
5. That the requested variance, as granted, is necessary for the preservation and
enjoyment of a substantial property right possessed by other property in the same vicinity
and zone, and denied Co the propoxty in question.
6. That the requested varisnce, as granted, will not be mat~rially detrimental to the
public welfare or injurious to the property or improvements in such vicinity and zone in
which the property i.s located.
7. That approximatc:ly four (4) pereone indicated their presence at said ;.ublic hear-
ing in oppoaition, three (3) of whom appeared; and no correapondence was received in
oppoeition Co sub~ect petition.

ENVIRONMENTAL IMPACT REPORT FINDING
~
That Environmental Impact Report No. 141 and a Supplement thereto. having been
considered this date by the City Planaing Commission and evideace, both written and
oral, having been presented to supplement said drsft of EIR No. 141, the City Planning
Co~ission believea that said draft of EIR No. 141 does conform to the City and State
Guidelines and the Stata of California Environmenta'1 Quality Act and, based upon such
information, does hereby recommend to the City Council that they certify said EIR is
in compliance with said Environmental Quality Act.
NOW, THEREFORE, BB IT RESOLVED that the Anaheim City Planning Commiasion does hereby
grant, in part, sub~ect Petition for Variance, upon the following conditions which are
hereby found to be a necessary prerequisite to the proposed use of the aub~ect property
in order to preserve the safety and general welfare of the Citizens of the City of
Aiiuheim:
1. That this Variance is granted sub~ec~ to the complation of Reclassification
No. 74-75-23, now pending. •
