THAT PETITION FOR VARIANCE N0. 2657 BE DENIED.
WHEREAS, the City Planning Commission uf the City of Anaheim did receive a
verified Petition for Variance from DEW CONSTRUCTION COMPANY, INC., 4620 East
La Palma Avenue, Anaheim, California 92807 (Owner); OMEGA BOATS, INC„ 4640
East La Palma Avenue, Anaheim, California 92807 (Age!it) of certain real propert•y
situated in the City of Anaheim, County of Orange, State of California, described
as:
That portion of the land shown as Navarro Tract on a Map showing the partition of
the M. Yorb; Estate, as show.~ on a Map filed in Book 1, page 27 of Records of
Surveys in the Office of the County Recorder of Orange Caunty, California, described
as follows:
Beginning at the Southeasterly corner of the land described in the deed to Glenn
Wiley and wife recorded May 5, 195o in Book 2008, page 566 of Official Records
of said Orange County; thence along the Easterly line of said land North 0° 29' S5"
West 347.76 feet to the Southerly line of La Palma P,venue, 106.00 feet wide, as
described in deed to the County of Orange recorded June 29, 1967 in Book 8296,
page 113 of said Official Records; thence along said Southerly line South 89° 59' 1p"
West 167.61 `eet; thence South 0° 27' 00" [ast 3~3.41 feet to the Southerly line
~f said land of Glenn Wiley and wife; thence along said last mentioned Southerly line
South 75° 14~ 48" East 173.99 feet to the point of beginning; and
WHEREAS, the City Planning Commission did hold a public hearing at the City
Hall in th~ City of Anaheim on February i9, 1975, at 1:30 p.m., notice of said public
haaring having been duly given as required by law and in accordance with the pro-
visions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence
for and against said proposed variance and to investigate and made findings and
recommendations in connection therewith; said public hearing having been continued
to the Planning Commission meeting of March 3~ 1975; and
WHEREAS, said Commission, after due inspection, im~estioation, and study made
by itself and in its behalf, and after due consideration of ail evidence and reports
offered at said hearing, does find and determine the following facts:
1, That the petitioner requests the following waivers from the Anaheim
i4unicipal Code, to permit the outdoor storage of boats in the ML(SC) (INDUSTRIAL,
LIGHT AND SCENIC CORRIDOR-OVERLAY) ZONE:
a. SE^TION 18.61.063.011 - Minimum front setback. (9oat storage not
permitted in front setback area)
b. SECTION 18.61.064.020 - Maximum fence hei ht, (~0 inches permitted;
~ feet existing
c. SECTION 18.61.066.05~ - tlinimum number of parkinq spaces. (54 spaces
required; 11 spaces proposed)
d. SECTION 18.61.068.030 - Required enclosure of out~oor uses. (6-foot
chainlink fence with wood slats required)
2, That the fnregoin9 waivers are hereby denied on the basis that the parking of
the boats in the req~+ired fron: setback would be construed as outdoor storage and,
therefore, would set an undesirable precadent in the affected zone.
3, That there are no exceptional or extraordinary circumstances or conditions
applicable to the property involved or to the intended use of the rroperty that do
not apply generally to the property or class of use in the same vicinity and zone.
4. That the requested variance is unnecessary for the preservation and enjoyment
of a subsYantial property right possessed by other property in the same vicin~ty and
zone, and denied to the property in question.
5, That the requested variance will be materially detrimental to the public
welfare or injurious to the property or improvertw_nts in such vicinity and zone in
which the property is located.
6. That no one indicated their presence a*_ said pubiic hearing in opposition,
and no correspondence was received in opposition to subject petition.

That the Director of Development Services h%~s deter~ined that the proposed
activity falls within Lhe definition oi Section 3•O1, Class 5 of the City of
Anaheim Guidelines to the Requirements for an Environmental Impact Report and
is, therefore, categorically exempt from the requirement to file an EIR.
NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does
hereby deny subjert Petition for Variance on the basis of the aforementioned findings.
THE FOREGOING RESOLUTION is signed and approved by me this 3rd day of March,
