A RESOLUT{ON OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM
'THAT PETITION FOR CONDITIONAL USE PERM~T N0. 1519 BE GRANTED.
WHEREAS, The Cit~~ Planning Commission of the City of Anaheim did receive a
verified Petition for Conditional Use Permit from DALE E. AND SARAH ANN FOWLER, 1430
South Grand Avenue, Santa Ana, California 92705 (Owner); DONALD E. FOSTER, 15Z5
East Alpha Lane, Anaheim, California 92$05 (Agent) of certain real property
situated in the City of Anaheim, County of Orange, State of California, described
as:
Lots 21, 22, 23 and 24 of "Eucalyptus Forest Tract" as shown on a map recorded i~
Book 5 pa9es Z9 and 30 of Miscellaneous Maps, records of said Orange County.
EXCEPTING THEREFROM the South 30 feet of the East 100 feet of Lot 23.
ALSO EXCEPTING THEREFROM the Southerly 135 feet of Lots 23 and 24; and
WHEREAS, the City Planning Commission did hold a public hearing at the City
Hall in the City of Anaheim on March 3, ~975, at 1:30 p.m., n~tice of said public
hearing having been duly given as required by law and in accordance with the pro-
visions of the Anaheim Municipal Code, Chapter 18.03~ to hear and consider evidence
for and against said proposed conditional use and to investigate and make findings
and recommendations in connection therewith; and
WHEREAS, said Commission, after due inspection, invesxigation, and study made
by itself and i~ its behalf, and after due consideration of all evidence and reports
offered at said hearing, does find and determine the following facts:
1, That the proposed use is properly one for which a conditional use permit
is authorized by Code Section 18.61.050.070, to wit: permit an automobile and
truck wheel alignment, brake ani~ fCafilB repair service in an existing industrial
complex in the ML (INDUSTRIAL, L16HT) ZONE,
2, That the petitioner stipulated that all services and/or work will be
performed inside the building.
3, That the petit7oner stipulated that the automotive vehicles on the
premises for repair work will park in the parking spaces in the rear of the
building and will not utilize the parking spaces provided along Red Gum Street.
4. That the petitioner stiipulated that the maximum size of the automotive
vehicles to be serviced and/or repaired will not exceed one and une-half (1~)
tons.
5. That the proposed use will not adversely affect the adjoining land uses and
the growth and development of the area in which it is proposed to be located.
6. That the size and shape of the site proposed for the use is adequate to
allow the full development of the proposed use in a manner not detrimental to the
particular area nor to the peace, health, safety, and general welfare ef the
Citizens of the City of Anaheim..
7, That the granting of the Conditional Use Permit under the conditions
imposed, if any, will not be detrimental to the peace, health, safety, and
~eneral welfare of the Citizens of the City of Anaheim.
8, That no one indi~ated their presence at said public hearing in opposition,
and no correspondence was received in opposition to subjecC petition.
ENVIRONMENTAL IMPACT REPORT FINDING:
That the Director of Deveiopment Services has determined that the proposed
activity falls within the definition of Section 3.~1, Class 1 of the City of Anaheim
Guidelines to the Requirements for an Environmental Impact Report and is, there-
fore, categoricalfy exempt from the requirement to file an EIR.

NOW, THEREFORE, B~ RESOLVED that the Anaheim City~Planning Commission does
liereby grant subject Petition for Conditional Use Permit, upon the following con-
~iifions which are hereby found to be a necessary prerequisite to the proposed use
of the subject property in order to preserve the safety and general welfare of the
Citizens of the City of Anaheim:
l. That subject property shall be developed substantially in accor:fance with
plans and specifications on file with the City of Anaheim marked Exhibit Nos. 1,
2 and 3.
2. That all services and/or work shall be performed inside r,ne building, as
stipulated to by the petitioner.
3, That the automotive vehicles on the premises for servicing and/or repair
work shall park in the parkin9 spaces in the rear of the buiiding and shaii not
ut~lize the parkin9 spaces provided along Red Gum Street, :s stipulated to by Che
petitioner.
4. That the maximum size of the automotive vehic?es to be serviced and/or
repaired at the subject location shall not exceed one and one-half (1'-z) tons, as
stipulated to by the petitioner.
THE FOREGOING RESOLUTION is signed and approved by me this 3rd day of March,
