WHEREAS, the City Planning Commission of the City of Anaheim did receive verified Petition foF Variance from ANNETTA CASELLA., 3030 BuYterfield, Orange, California ':•2667 (Owner)• 5. M. ROBINSON, 8470 Garden G ro~•e Boulevard, Garden Grove, California 92644 (Agent) of certain real prop~rty situated in the City of Amaheim, County of Orange, State of California, described as: The South 220.~0 feet ~f the East 203.00 feet, measured from the centerlines c' the streets, of Lot 7 i:i Block 5~f the Golden State Tract as shown on a Map recorded in book 4, pages 66 and 67 of Miscellaneous Maps, rpcords of Orange County, California; and WHER~AS, tF~e City Planning Commission did hold a puLlic hearing at the Clty liall in the City of AnaF.eim on March 3, 1975, at 1:30 p.m., notice of said p~~~lic hearing having been duly given as required by law and in accordance with the provisfons of the Anaheim Municipal Code, Chapter 18.03, t~ hear and consider evidence for anJ against said proposed variance and to investigate and make indings and recommendations in connection therewith; and WHEREAS, said Commission, after du~ inspection, investigation, ~+nd stud~ made by itself and in its behalf, and aFter due consideration of all evidence anr rt:ports offered at said hearing, does find and determine *.r~e followin9 fact.: l. That the petitioner requests the folluwing waivers from the Anaheia Municipal Code, to permit the continued operation of an equipment rental f~cility: a. That Waivers 1-a, I-b and 1-c, above-~~entioned, are hereby grar.•,~d for a cime limitation of one (1~ year, on the basis that the petitioner demons•rated that an extreme hardship would be created if said waivers were not grant~ i. 3. That tlie Planning Commission determfned there shall be no outdo~~ storage or dispiay permitted within the required 5~-foot minimum front setback aieas nor under the canopies. 4. That the petitioner stipulated that the trash storage areas wilf be re- located and provided in accordance with approv~d plans on file with the C fice of the Director of Public Works. 5. That the requested variance is necessary for the preservation an~ enjoy- ment of a substantial property right possessed by other property in the s:ne vic~nity and zone, and denied to the property in question. 7, That the requested varianr.e will not be materially detrimental tc the public welfare or injurious to the proper:y or irttiprovements ln such vicini;y and zone in which the property is located. 8. That no one indicated their presence at said p~blic hearing in opoosition, and no correspondence was receivc:d in opposition to s:iliject petition. RESOLUTION N0. PC75-52 NVIRONMENTAL IMPACT REPORT FiNDiNG: That the Director of Development Services has determined that the proposed activity falls within Che definition of Section 3•Ol, Class 1 of the City oF A.naheim Guidelines to the Requirements for an Environmental impact Report and is, cherefore, categorically exempt from the requirement to file an EIR. NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby grant subject Petition for Variance, upon the following conditions which are hereby found to be a necessary prerequisite to the proposed use of the subject property in order tc preserve the safety and 9eneral welfare of the Citizens of the City of Anaheim: 1. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibit No. 1; provided, however, that the trash storage areas shall be relocated and provided in accordance with approved plans on file with the Office of the Director of Public Works, as stipulated to by the petitioner. 2. That Condition No.l, above-mentioned, shall be complied with within a period of ninety (90) days from date hereof, or such further time as the Planning Cor~~mission may grant. 3. That ther~• shali be no outdoor storage or display permitted under the canopies nor within the required 50-foot minimum front setback areas. 4. That a time limitation of one (1) year shall be granted for the use of the subject property, after which time and upon request by *_he petitianer, considerat~.o~ may be given to an extension of Yime.
