A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM
THAT I`ETITION FOR CONDITIONAL USE PERMIT N0. 1521 BE GRANTED,
WHEREAS, the City Planning Commission of the City of Anaheim did receive a
verified Petition for Corditional Use Permit from KOLL INCOME PROPERTIES, P. 0.
Box 5000, Irvine, California 92654 (Owner); RENE STAPFER, Rene's Sandwich Place,
1440 South State College Boulevard, Anaheim, California 92806 (Agent) of certain
real property situated in the City of Anaheim, County of Orange, State of Cali-
fornia, described as:
The West 10.00 acres of the South half of the Southwest quarter of the Northwest
quarter of Section 24, Township 4 South, Range 10 Wes't, in the Rancho San Juan
Cajon de Santa Ana, as per Map recorded in Book 51, Page 10 of Miscellaneous
Maps, in the office of the County Recorder of said Orange Couiity; and
WHEREAS, the City Planning Commission did hold a public hearing at the City
Hall in the City of Anaheim on March 17, 1975, at 1:30 p.m., notice of said public
hearing having been duly given as required by la~~ and in accordance with the pro-
visions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence
for and against said proposed conditional use and to investigate and make findings
and recommendations in connection therewith; and
blHEREAS, said Commission, after due inspection, investigation, and study made
by itself and in its behalf, and after due consideration of all evidence and
reports offered at said hearing, does find and determine the following facts:
1. That the proposed use is properly one for which a conditional use permit
is authorized by Cede S~ction 18.61.050.400, to wit: permit the retail sale of
sandwiches in an existing industrial complex.
2. That the petitioner stipulated that the intent is to serve the industrial
complex and the present hours of operation are from 9:00 a.m, to 3:00 p.m, and
that the food items will be served cold.
3, That the proposed use will not adversely affect the adjoining land uses
and the growth and development of the area in which it is proposed to be located.
~F, That the size and shape of the site proposed for the use is adequate to
allow the full development of the pruposed use in a manner not detrimental to
the particular area nor to the peace, health, safety, and general welfare of the
Litizens of the City of Anaheim.
5, That the granting of the Conditional Use Permit under the conditions
imposed, if any, will not be detrimental to the peace, health, safety, and
general welfare of the Citizens of the City of Anaheim.
6. That no one indicated their presence at said public hearing in oppositior.;
and no correspondence was received in opposition to subject petition.
ENVIRONMENTAL IMPACT REPORT FINDING:
That the Director of Development Services has determined that the proposed
activity falls within the definition of Section 3.0~, Class 1 of the City of Anaheim
Guidelines to the Requirements for an Environmental Impact Report and is, therefore,
categorically exempt from the requirement to file and EIR.
NOW, TNEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does
hereby grant subject Petition for Conditio~al Use Permit, upon the following
conditions which are hereby found to be a necessary prerequisite to the proposed
use of the subject property in order to preserve the safety and general welfare of
the Citize~s of the City of Anaheim:
l. That subject property shall be developed substantially in accordance with
plans and specifications on file with the City of Anaheim marked Exhibit No, l.
