A RESOLUTION OF THE LITY PLANNING COMMISSION OF TH"c CITY 0~ ANAHEIM
THAT P:TITION FUR CONDITIONAL USE PERMIT NO 1522 BE GRANTED.
WHEREAS, the City Planning Lommission of the City of Anaheim did receive a
verified Petition for Conditional Use Fermit from ROGERS A. AND BARBARA A.. SEVERSON,
3814 Topside Lane, Corona Del Mar, California 92625 (Owner); M. L. CAMPBELL,
23045 Maple Street, Torrance, California 90501 (Agent) of certain real property
situated in the City of Anaheim, County of Orange, State of California, described
as:
Lots 159, 160, 161, 162 and 163 of the Eucalyptus Forest Tract, as shown on a map
recorded in 8ook 5, pages 29 and 30 of Miscellaneous Maps, records of said Orange
County, together with the Southeasterly 20.00 feet of Santa Ana Street adjoining
said lots on the Northwest and the Southwesterly 20.00 feet of an unnartwd street
adjoining said Lot 163 on the Northeast, as vacated by the Doard of Supervisors
of said Orange County on January 16, 1917 as shown in Minute Book 12, page 37Z•
Excepting therefrom that portion thereof lying Southwesterly of the Northeasterly
line of the land described in that certain Final Order of Condemnation, Superior
CourC Case No. 126804, a certified copy of which was recorded July 23, 1965 ~n Book
7605, page 605 of Official Records; and
WHEREAS, the City Planning Commission did hold a public hearing at the City
Hall in the City of Anaheim on March 17, 1975, at 1:30 p.m., notice of said public
hearing having been duly given as required by law and in accordance with the
provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider
evidence for and against said proposed conditional use and to investigate and
make findings and recommendations in connection therewith; and
WHEREAS, said Commission, after due inspection, investigation, and study
made by itself and in its behalf, and after due consideration of all evidence and
reports offered at said heari~g, does find and determine the following facts:
l. That the proposed use is properly one for which a conditional use permit
is authorized by Code Section 18.61.050.390, to wit: permit a restaurant in an
existing industrial complex, with waive~• of:
SECTION 18.01.190 - Minimum kitchen area. (25% of gross floor area
required; 9% proposed)
2, That the above-mentioned waiver and the use are hereby granted on the basis
that the petitioner stipulated that the proposal is for a take-out, sit-down,
convenience type restaurant primarily to serve the industrial complex at the
subject location, and only sandwiches, hot soup and salad food items will be
served and/or prepared on the premises; and that there v,ill be no cooking other
than for heating soups, nor will any alcoholic beverages be sold or consumed,
on tne premises.
3. That the petitioner indicated that the hours of operatior, will be fran
9:00 a.m, to 2:30 p.m,
4. That the proposed use will not adversely affect the adjoining land uses
and the growth and development of the area in which it is proposed to be locat.ed.
5, That the size and shape of the site proposed for the use is adequate to
allow the full development of the proposed use in a manner not detrimental to the
particular area nor to the peace, health, safety, and general ~aelfare of the
Citizens of Che City of Anaheim,
6. That the granting of the Conditional Use Permit under the conditior+s
imposed, if any, will not be detrimental to the peace, health, safety, and general
welfare of the Citizens of the City of Anaheim,
7, That no one indicated their presence at said public hearing in oppcsition,
and no correspondence v.~s received in opposition to subject petition.
ENVIRONMENTAL IMPALT REPORT fINDING:
That the Director of Develop~nt has determined that the proposed activity
falls within the definition of Section 3.01, Llass 1 of the City of Anaheim Guide-
lines to the Requirements for an Environmental Impact Report and is, therefore,
categorically exempt from the requirement to file an EIR.

NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does
hereby grant subject Petition for Conditional Use Permit, upon the following con-
ditions whi:,h are hereby found to be a necPSSary prerequisite to the proposed use
of the subject property in order to preserve the safety and general welfare of the
C~tizens of the C9ty of Anaheim:
1. That sidewalks shall be installed along Blue Gum Street and Whitestar
Avenue as required by the City Engineer and in accordance with standard plans and
specifications on file in the office of the City Engineer.
2. That subject property shall be developed substantially in accordance with
plans and specificat3ons on File with the City of Anaheim marked Eahibit Nos. 1
through 4.
3. That Condition Nos. 1 and 2, above-mentioned, shall be complied with prior
to the commencement of the activity authorized under this resolution, or prior to
the time that the building permit is issued, or within a period of one year from
date hereof, whichever occurs first, or such further time as the Planning Commission
and/or City Council may grant.
4. That the use of the subject property is granted for a take-out, sit-down
c~nvenience type restaurent, and only sandwiches, hot soup and salad food items
shall be served and/or prepared on the premises; and there shall be no cooking
other than for heating soups, nor shall any alcoholic beverages be sold or con-
sumed on the premises, all as stipulated to by the petitioner.
