A RESOLUTION OF THE LITY PLANNING COMMISSION OF THE LITY OF ANAHEIM
THAT PETITION FOR CONDITIONAL USE PERMIT N0. 1524 BE GRANTED IN PART.
WHEREAS, the City Planning Lommission of the Gity of Anaheim did receive a
verified Petition for Conditional Use Permit from THE SALVATION ARMY, 129 East
Cypress, Anaheim, California 92805 (Owner); LEROY ROSE AND ASSOCIAT[S, 1440 South
Sta:e College Boulevard, Anaheim, California 92806 (Agent) of certain real property
situated in the City of Anaheim, County of Orange, State of C~li`ornia, described
as:
Lots 79, 80, 81, 82, 83 and 84 in Block "F" of Heimann and George's Addition as
recorded in Book 2, page 249 of Miscellaneous Records of Los Angeles County,
Lalifornia.
Lot 78 in B!ock F of Heim~nn and George's Addition to Anaheim, as per map recorded
in Book 2, Pages 24$ and 249 of Miscellaneous Records of Los Angeles County,
California; and
WHEREAS, the City Planning Commission did hold a public hearing at the City
Hall in the City of Anaheim on March 17, 1975, at 1:30 p.ni., notice of said public
hearing having been duly given as required by law ancf in accordance with the pro-
visions of the Anaheim Municipal Code, ChapCer 18.03, to hear and consider evidence
for and against aaid proposed conditional use and to investigate a~d make findi~gs
and recommendations in connection therewith; and
WHEREAS, said Commission, after due inspection, investigation, and study made
by itself and in its behalf, and after due consideration of ~11 evide~ce and reports
offered at said hearing, does find and determine thr_ following facts:
l. That the proposed use is properly one for which a conditional use permit
is authorized by Code Sections 18.45.~50.130 and 18.81,050.030, to wit: construct
church facilities i~ the CG (COMMERCIAL, GENERAL) AND PD-C (PARKING DISTRICT-
COMMERCIAL) ZONES, with waivers of;
a, SECTION 18.06.060.0265 - Minimum number of parkinq space5. (~,0 spaces
required; 15 spaces propcsed)
b. SECTION 18.81.060.020 - Minimum front setback.
2, That Waiver 1-a, above-mentioned, is hereby granted on the basis that the
petitioner represented that their existing facility in the area has I1 parking
spaces, which will be available to the proposed facility in addition to the 15
proposed spaces; said existing facility requiring only 5 parking spaces with
regular use and less than 11 spaces with heavy use.
3. That it is determined that Waiver 1-b, above-mentioned, is not required.
4. That the signing af the proposed use will comply with the specifications
of the C~ and PD-L zones, as stipulated to by the petitioner.
5, That the proposed use, as gra~ted, will not adversely affect the adjoining
land uses and Che growth and development of the area in which it is proposed to be
located.
6, That the size and shape of the site proposed for the use, as granted, is
adequate to allow the full development of the proposed use in a manner not detri-
mental to the particular area nor to the peace, health, safety, and general welfare
of the Citizens of the City of Anaheim.
7, That the Conditional Use Permit, as granted and under the conditions
imposed, will not be de!rimental to the peace, health, safety, and general
welfare of the Citizens of the City of Anaheim,
$, That no one indicated their presence at said public hearing in oppositton,
and no cerrespondence was received in opposition to subject petition.
ENVIRONMENTAL IMPACT REPORT FINDING:
That the Pla m ing Commission recommends to the City Council that the subject
project be exempt from the requirement to prepare an Em~ironmental Impact Report,
pursuant to the provisions of the California Environmental Quality Act.

NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Lommissiun does
hereby grant, in part, subject Petition for Conditional Use Pernit, upon the
following conditions which are her~by found to be a necessary prerequisite to the
proposed use of the sub;ect property in order to preservc the safety and gencral
welfare of the Citizens of the City of Anaheim:
1. That trash storage areas shall be provided in accordance with approved
plans on file taith the office of the Director :,f Public Works.
2. That fire hydrants shall be installed and charged as required and
determined to be necessary by the Chief of the Fire Uepartmc:nt prior to commence-
rtu:nt of structural framing.
3, That subject property shall be served by ur~der~round uLiiities.
4. That a 6-foot masonry wall shall be constructed along the north proper[y
line, except where the proposed building is located odjacent to said property line.
5, That damaged and/or hazardous sidewalks shsll be removed and/or recon-
structed along Emily Street and that curbs shall be removed and/or reconstructed
along Cypress Street as required by the City Enginecr and in accordance wlth
standard plans and specifications on fiie in the o(fic~ of the City Engineer.
6. That drainage of subject property shalf be disposed of in a manner satis-
factory to the City E~gineer•.
7. That the owner(s) of subJect property shall Pa1're°stStreetYand EmajYim
the sum of 60C per front foot atong Claudina Street, Cyp
Street for tree planting purposes.
8, That all air-conditioning facilities shall be properly shielded from
view, and the sound buffered from :edjacent properties,
9, That any external lighting proposed on subject p~operty sliall be directed
downward and away from abutting property lines.
10. That subject property shall be developed substantially in accordar,ce with
plans and specifications on file with the City of Anaheim marked Exhibit Nos. 1 thru 4;
prpvided, however that ~igning shall comply with LG and PD-C Zone requirements, a5
stipulated to by Ehe petitioner.
I1, That Condition No. 7, above-mentioned, shall be complied with prior to
the commencement of the activity authorized under this resolution, or prior to
the time that the building permit is issued, or within a period of one ycar from
date hereof, whichever occurs first, ar such further time as the Planning Commission
and/or City Council may grant.
12, That Condition Nos. 1, 3, 4. 5, 6~ 8~ 9 and 10, above-mentioned, shail be
complied with prior to fin~l building and zoning inspections,
