PC75-59 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM THAT PETITION fOR VARIANCE N0. 2681 DE GRANTED IN PART, WHEREAS, the City Plannirg Commission of the City of Anaheim did receive a verified Petition for Variance from PETE'S ROAD SERVICE, 1193 Blue Gum Street, Anaheim, California 92806 (Owner) u~ certain real property situated in the City of Anaheim, County of Orange, State of California, described as: That portion of the North half of Lot 7 in Block 11 of Golden State Tract, as shown on a map thereof recorded in boolc 4, page 66, Miscellaneous Maps, records of said Orange County, described as follows: Beginning at the most Northerly corner of said Lot 7, said corner being for purposes of this description, the intersection of the center line of Coronado Stree:~ with the center line of Blue Gum Street, as shown on a map filed in book 61, page 7, Record of Surveys, in the office of the County Recorder of said Orange County; thence South 16° 19' 43" East along the Easterly line of said Lot 7, being said center line of Biue Gum Streeta 329•97 feet to the Southerly line of said North half of Lot 7; ttience South 73 37' S1" West along said Southerly line 200.00 feet; thence North 16° 19' 43" West 329.97 feet to the Norther?y line of said Lot 7, being said center line of Coronado Street; thence North 73° 37' S1" East along said Northerly l~ne 200.00 feet to the point of beginning; EXCEPT the Southeasterly 160 feet thereof; and WHEREAS, the City Planning Commission did hold a public hearir,g at the City Hall in the City of Anaheim on March 17, 1975, at 1:30 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed variance and to investigate and make findinys and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation, and study made by itsolf and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: 1, That the petitioner requests the following waivers from the Anaheim Municipal Code, to permit the outdoor storage of a boat in conjunction with a truck tire servicing facility: a. SECTION 18,61,028 - Permitted outdoor uses. (Storzge of boat not permitted b. SECTION 18.6i.066.050 - Minimum number of parking_spaces. (6 spaces required; s aces existing) c. SECTION 18.61.068.030 - Required encl•osure of outdoor uses. (Stored item not to exceed height of screen) 2. That Waiver i-a, above-mentioned, is hereby granted on the basis that tlie oetitioner demonstrated that a hardship would be created iti~ said waiver was not granted. 3. That Waive 1-b, above-mentioned, fs withdrawn by the petitioner witl~ Che stipulation that six (6) marked parking spaces will be provided on the premises at all times. 4. That Waiver 1-c, above-mentioned, is hereby granted on the basis that the petitioner demonstrated that a hardship would be created if said waiver was not granted, since the hei9ht of thz boat to be sto~ed is approximately 14 feet. 5. 7hat there are except~onal or extraordinary circumstances or conditions applicable to the property involved or to ~he intended use, as granted, of the property that do no apply generally to the property or class of use in the same vicinity and zone. 6. That the requested variance, as granted, is necessary for the preservation and enjoyment of a substantial property right possessed hy other property in the same vicinity and zone, and denied to the property in question. 7. That the requested variance, as granted, will not be materially deLri- mental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located. 8. 7hat no one indicated their presence a*.. said public hearing in opposition, and no correspondence was received in opposition to subject petition. RESOLUTION N0. PC75-59 _-~ ~ ~ ENUIRO~MENTAL IMPACT REPORT FINDING: That the Director of Development Seivices has determined that the proposed. activity falls within the definition of Section 3.01, Class 1 of the Citv of Anaheim Guidelines to the Requirements fur an Environmental Impact Report and is, therefore, categorically exempt from the requirement to file an EiR, NOW, THEREFORE, BE IT RESOLVED th;at the Anaheim City Planning Commission does hereby grant, in part, subject Petition for Variance upon the following r.onditions which are hereby four~d to be a necessary prerequisite to the proposed use of the subject property in order to preserve the safety and general welfare of the Citizens of the City of Anaheim: 1. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibit No. 1; provided, however, that six (6) marked parking spaces shall be providr.d on the premises at all times, as stipulated to by the petitioner.
