A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE ClTY OF ANAHEIM
THAT PETITION FOR CONDITIONAL USE PERMIT N0. 1527 BE GRANTED.
WHEREAS, the City Planning Commission of the City of Anaheim did receive a
verified Petition for Conditional Use Permit from MR. AND MRS. GENE A. ALBIN, SR.,
354 East Orangewood Avenue, Anaheim, California 92802 (Owner) of certain real
property situated in the City of Anaheim, County of Orange, State of California,
described as:
Parcel 1: The East 157 feet of the North 150 feet of the East Z of Lot 15 of
the Orangewood Tract as per map thereof recorded in Book 7, Page 42 of Mis-
cellaneous Maps, records of said Orange Co~nty, California; and
WHEREAS, the City Planning Commission did hold a public heariny at :he City
Hall in the City of Anaheim on March 3~, ~975, at 1:3~ p.m., notice of said
public hearing having been duly given as required by law and in accordance with
the prw isions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider
evidence for and against said proposed conditional use and to investigate and
made findings and recommendations in connection therewith; and
WHFREAS, said Commission, after due inspection, investigation, and study
made by itself and in its behalf, and after due consideration of all evidence
and reports offered at said hearing, does find and determine the following
facts:
1, That the proposed use is properly one for which a conditional use
permit is authorized by Code Section 18.21.050,090, to wit: permit the expansion
of an existing board and care facility wfth waiver of:
SECTION 18.21.066.011 - Minimum number of parkinq spaces in a qaraqe.
(2 spaces required; 1 space, proposed)
2, That the above-mentioned waiver is hereby 9ranted on the basis that the
request is reasonable for the proposed use and since five a~ditional parking
spaces are provided on the property.
3, That the propose~ use will not adversely affect the adjoining land uses
and the growth and development of the area in which it is proposed to be located.
4. That the size and shape of the site proposed for the use is adequate
to alE~~ the full development of the proposed use in a manner not detrimental to
the particular area nor to the peace, health, safety, and general welfare of
the Citizens of the City of Anaheim.
5, That the granting of the Cond~tional Use Permit under the conditions
imposed, if any, wi11 not be detrimental to the peace, health, safety, and
general welfare of the Citizens of the City of Anaheim.
6. That no one indicated their presence at said public heartng in opposition,
and no correspondence was received in opposition to subject petition.
ENVIRONMEIJTAL IMPACT REPORT FINDING;
That the Director of Development Services has determined that the proposed
activity falls within the definition of Section 3.01, Glass 1 of the City of
Anaheim Guidelines to the Requirements for an F.nvironmental Impact Report and
is, therefore, categoricallly exempt from the requirement to file an EIR.
NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission
does hereby grant subject Petition for Conditionai Use Permit, upon the following
conditions which are hereby found to be a necessary prerequisite to the proposed
use of the subject property in order to preserve the safety and general weifare
of the Citizens of the City uf Anaheim:

' 1. That the owner(~ f subject property shall deed the City of Anaheim
a strip of land 45 feet i~viidth from the centerline of tfi stree~ along
Orangewood Avenue for street widening purposes, as stipulated to by the petitioner.
2. That all engineering requirements of the City of Anaheim, along Orange-
wood Avenue including preparation of improvement plans and installation of all
improvements such as curbs and gutters, sidewalks, street grading and paving,
drainage facilities, or other appurtenar.t work shall be comFlied with as
required by the City Engineer and i,-~ accordance with standard plans and
specifications on file in the office of the City Engineer; that street lighting
facilities along Orangewood Avenue shall be installed 3s required by the
Director of Public Utilities, and in accordance with standard.plans and
specifications on file in the office of the Director of Public Util(ties; and
that a bond in an amount and form satisfactory to the City of Anaheim shall be
posted to guarantee the installatior of the herein-mentioned improvements, said
bond to be posted prior to commencement of the activity authorized under thi<.
resolution or prior to the time that the building permit is issued, or within a
period of one (,1) year, wh;chever occurs first; provided, however, that the
bonding privileges shall be granted for one (1) year, to expire on March 31,
1976, at which time the herein-mentioned improvements shall be complered, as
stipulated to by the petitioner. •
3, That the owner(s) of subject property shall pay to the City of Fnaheim
the sum of 60G per front foot along Oranyewood Avenue for tree planting purposes.
4. That trash storage areas shall be provided i~~ accordance with approved
plans on file with the office of the Direct~r of Public Works.
5, That fire hydrants shall be installed and charged as required and
determined to be necessary by the Chief of the Fire Department prior to commence-
ment of structural framing.
6. That appropriate water assessment fees, as determined by the Director
of Public Utilities, shall be paid to the City of Anaheim prior to the issuance
of a building permit.
7, That subject property shall be developed substantially in accordance
with plans and specifications on file with the City of Anaheim marked Exhibit No.
1.
8. That Condition Nos. 1 and 3, above-mentioned, shall be complied with
prior to the commencement of the activity authorized under this resolution,
or prior to the time that the building permit is issued, or within a period af
one year from date hereof, whichever occurs first, ar such further time as the
Planning Commission may grant.
9, That Condition Nos. 4 and 7, above-mentioned, shall be complied with
prior to final 'uuilding a~d zoning inspections.
