RECOMMENDING TO THE CITY COUNCIL OF THE CITY OF ANAHEIM THAT PETITION
FOR RECLASSIFICATION N0. 74-75-29 BE APPROVED.
WHEREAS, the City Planning Commission of the City of Anaheim did receie•e
a verified Petition for Reclassification from RAY G. AND ALICE E. SIMPSON,
15419 Cool Valley Road, Valley Center, San Diego, California 92082 (Owner);

90631 (Agent) of certain real property situated in the City of Anaheim, County of
Orange, State of California, described as:

EXCEPT THEREFROM that portion of said land lying Southwesterly of the line

WHEREAS, the City Planning Commission did schedule a public hearing at the
City Hall in the City of Anaheim on March 31. 1975, at 1:30 p.m., notice of said
public hearing having been duly given as required by law and in accordance with
the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and c~nsider
evidence for and against said proposed reclassification and to investigate and
make findings and recommendations in connection therewith; said public hearing
having been continued to tfie Planning Commission meeting of April 14, 1975; and
WHEREAS, said Commission, after due inspection, investigation and study made
by itself and in its behalf, and after due consideration of all evidence and
reports offered at said hearing, does find and determine the following facts:

l~ That the petitioner proposes reclassication of the above-described property
from the CH (COMMERCIAL, HEAVY) to the ML (INDUSTRIAL, LIMITED) ZONE.
2. That the Anaheim General Plan desi9nates subject property for 9eneral
indust•rial uses.
3. That the proposed reclassification of subject property is necessary and/or
desirable for the orderly and proper development of the r,ommunity.
4. ThaC the proposed reclassification of subject property does properly relate
to the zones and their permitted uses locally established in close proximity to
subject property and to the zones and their permitted uses generaliy established
throughout the community.
5. That the proposed reclassification of subject property requires the dedica-
tion and improvement of abutting streets in accordance with the Circulation
Eler~ent of the General Plan, due to the anticipated increase in traffic which wi11
be generated by the in[ensification of land use.
6. Tha*_ two (2) persons appeared at said public hearing in opposition and three
(3) petitions containing approximately ten (10) signatures in opposition were received.
cNVIRONMENTAL IMPACT REPORT FINDING:
That the Planning Commission recommends to the City Council that the subject
project be exempt from the requirement to prepare an ~nvironmental Impact Report,
pursuant to the provisions of the California Environmental Quality Act.
NOW, THEREFORE, BE 1T RESOLVED that the Anaheim City Planning Commission does
hereby recommend to the City Council of the City of Anaheim that subject Petition
for Reclassification be approved and, by so doing, that T~tle 18-Zon~ng of the
Anaheim Municipal Code be amended to exclude the above-described property from the
CH (COMMERCIAL, HEAVY) ZONE and to incorporate said described property into the
ML (INDUSTRIAL, LIMITEDj ZONE upors the following conditions which are hereby found
to be a necessary prerequisite to the proposed use of subject property in order to
preserve the safety and general welfare of the Citizens of the City of An~heim:
1. That the owner(s) of subject property shall deed to the City of Anaheim a
strip of land 50 feet in width from the centerline of the street along Anaheim
Boulevard for street widening purposes.
2. That sidewalks shall be installed along Anaheim Boulevard as required by
the City Engineer and in accordance with standard plans and specifications on file
in the office of the City Engineer.
3. That the owner(s) of subject propef•ty shall pay to the City of Anaheim
the sum of $2.00 per front foot along Anaheim Boulevard for street li9hting purposes.
4. That trash storage areas shall be provided in accordance with aFproved plans
on file with the office of the Director of ?ublic Works.
5. That fire hydrants shall be installed and charged as required and determined
to be necessary by the Chie~ of the Fire Department prior to commenr,ement of struc-
tural framing.
6. That subject property shall be served by underground utilities.
. 7. Tt~at drainage of subject property shall be disposed of in a mariner satis-
factory to the City Engineer.
8. That appraP<<ate water assessment fees, as determined by the Director of
Public Utilities, shall be paid to the City of Anaheim prior to the issuance of a
building permit.
9, Prior to the int:oducl•ion of an ordinance rezoning subject property,
~ondition Nos. 1 and 3, above-mentioned, shall be completed. The provisions or
rights granted by this resoluticn shall become null and void by action of the City
Council unless said conditions are complied with within one year from the date
hereaf, or such further time as the ~ity Council may grant.

10. That Condition Nos. 2, 4, 6 and 7, above-mentioned, shall be complied
with.prior to final building and zoning inspections.
