A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM
THAT PETITION FOR VARIANCE N0. 2689 BE GRANTED, IN PART.
WHEREAS, the City Planning Commission of the City of Anaheim did receive a
verified Petition for Variance from RAY G. AND ALICE E. SIMPSON, 15419 Cool
Valley Road, Valley Center, San Diego, California 92082 (Owner); DEL PROPERTIES,
Attn: Fred Walters, 730 South Cypress Street, La Habra, ~alifornia 90b31 (A9ent)
of certain real property situated in the City of Anaheim, County of Orange,
State of California, described as:
PARCEL l: That partion of the Southwest yuarter of the Southwest quarter of
Section 23, in Township 4 South, Range 10 West, in the Rancho San Juan Cajon de
Santa Ana, as shown on a map thereof recorded in book 51, page 7, et seq.,
Miscella~eous Maps, records of said Orange County, described as follows:
Beginning at a point in the cer~ter ifne of the State Highway, said point being
South 409.55 feet and Sou*_h 45 06' 3~" West 673.81 feet from the Northeast
corner o~ said Southwest quarter of the Southwest quarter of said section; thence
North 45 06' 3g" East 293•84 feet; thence North 44° 53' 30" West 148 feet;

Beginning at a polnt on the East Iine of said Southwest quarter of the Southwest
quarter 409.55 feet South of the Northeast corner of Che Southwest quarter of
the Southwest quarter of said Sectton 2~, and running thence South along said
East line, 482.16 feet; thence South 45 06' 30" West parallal with the North-
westerly line of that certain parcel of land conveyed to E. J. fieeves and H. F.
Reeves, by deed recorded in book 358~ page 20, Deeds, records of satd Orange
County, 359.3Q feet to a point in the center line of the 60 foot ~tate Highway

WHEREAS, the City Planning Commission did schedule a public hearing at the
City Hall in the City of Anaheim on March 31, 1975, at 1:30 p•m., notice of satd
public hearing having been duly given as rQauired by law •and in accordance wfth
the provfsions of the Anaheim Municipal Code, Chap:er i8.03, to hear and consider
evi~lence for and against said proposed variance and to investigate and make
findings and recommendatians in connection therewith; said public hearing having
been continued to the P1annSng Commisston meettng of April 14, 1975i and,
WHEREAS, satd Commission, aGeer due inspection, investigation ar~d study made
by !tself and in its behalf, and after due consideration of ail evidence and
reports offered at sa(d hearing, does find and determine the following facls:

l. That the petitioner requests the following waivers from the Anaheim
Municipal Code to construct a mini-warehouse:

2. That Waiver 1-a, above-mentioned, is hereby granted to allow 26 parking
spaces on the basis that the petitioner stipulated that the mini-warehouse units
located along the perimeter of the subJect property, which are proposed to be
constructed with a 10-foot minimum width, and a 20-foot minlmum depth, will be
converted to parking spaces in the event the proposed m:ni-warehouse use of the
property changes to a general industrial use, said parking space conversion to be
in accordance with Code requirements.
3, That Waivers 1-b and 1-c, above-mentioned, were eliminated by the resub-
mittal of plans and, therefore, withdrawn by the petitioner.
4. That although the proposal is to have masonry block constructton for the
first floor and steel with "TeaCoat" finish for the secund floor of the proposed
buildings, permission is hereby granted to construct the building entirely of steel,
in accordance with the City Council Metal Buildi~g Policy, since the petitioner
stipulated that said alternate building material would have a"TexCoat" finish,
resemblirg a stuccoed wall.
5. That if, at a future date, a change of the use of said property is proposed,
then the new proposed use will be subject to approval by the Planning Commission and/
or City Council, and the structures will be re~uired to be brought up to the minimum
standards of all Codes adoptad by the City of Anahelm,
6, That there are exceptional or extraordinary circumstances or conditions
applicable to the property involved or to the intended use of the property that do
not apply generally to the property or class of use in the same vicinity and zone,
7. That the requested variance is necessary for the preservation and enJoyment
of a substantial property right possessed by other property in the same vicinity and
zune, and dented to the property in question.
8. That the requested varlance will not be materially detrimental to the public
welfare or injurtous to Lhe property or improvements in such vicinity and zone in
which the property is located.
9, That the petitioner stipulated to terminating Conditional Use Permit No. 162
which was granted on September 18, 1961, to establish a trailer park.
10, That two (2) persons appeared at satd public hearing in opposition and three
(3) petitlons containing approximately ten (10) ~^i~natures tn opp~sition were received.
ENVIRONMENTAL IMPACT REPORT FINDING:
That the Planning Commission recommends to the City Council that the subJect project
be exempt from the requirement to prepare an Environn~:ntal Impact Report, pursuant to
the provisions of the Catifornia Environmental Quality Act.
NOW, THEREFORE, BE IT•RESOLVED that the Anaheim City Planning Commission does
hereby grant, in part, subJect'Petition for Variance, upon the following conditions
which are hereby found to be a neces~~ary prerequisite to the proposed use of the subJect
property tn order to preserve the safety and general welfare of the Citizens of the City
of Anaheim:
(1) That thTs Variance is granted subJect to tFie completion of Recle;,sific~Lion
No. 74-75-29.
(2) That this Variance ts granted subJect to the terminatlon of Conditional Use
Permit No. 162, as stipulated to by the petitioner.

(3) That trash storage areas shall be prcvided in accordance with approved
plans on file with the office of the Director o` Public Works.
(4) That the proposed metal buildings shall be constructed in accordance with
the adopted City Council Metal Building Policy and shall have a"TexCoat" finish,
as stlpulated to by the petitloner.
(5) That subject property shall be daveloped precisely in accordance with plans
and specifications on file with the City of Anaheim marked Exhibit Nos. 1(Revision
No. i), 2, and 3.
{6) That Condition Nos. 1 and 2, above-mentioned, shall be complied with prior
to the commetuement of the acl•ivity authorized under th~~. ~esolution, or prior to
the time that the building permit is issued, or wiYr:;~ a~;riod of one year from
date hereof, whichever occurs first, or such further time as the Planning Commission
and/or City Council may grant.
(7) That Co~dition Nos.3~ 4~~d S.above-mentioned, shall be complied with prior
to final building and zoning inspecttons.
(S) That if :he mini-warehouse use of the subject property is changed,the new
use shall be subject to approval by the Planning Cortmission and/or City Council; and
the structures and number of parking spaces shall be required to be broughC up to the
minimum standards of all Codes adopted by the City of Anaheim, as stipulated to by
the petitioner.
