PC 75-89„ ~ ~ RESOLUTION N0. PC75-89 A RESOI.UTION OF THE CITY PLANNING COMMISS:ON OF THE CITY OF ANAHEIM THAT PETITION FOR CONDITIONAl. USE PERMIT N0. 1532 BE GRANTED. WHEREAS, the City Planning Commissior~ of the City of Anaheim did receive a verified Petition for Conditional Use Permit from EDWARD L. AND PATRICIA B. SCANLAN, 1112 Wakefield Place, Anaheim, California 92802 (Owners) of certain real property situated in the City of Anaheim, County of Orange, State of California described as: Lot 18 of Tract 2723, as per Map recorded in Book 84, Pages 19 to 21 inclusive of Miscellaneous Maps, in the office of the County Recorder of said Orange County; and WHEREAS, the City Planning Commission did hold a public hear'ng at the City Hall in the City of Anaheim on April 28, 1975, at 1:30 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and conside~ evidence for and against said proposed conditional use and to investigate and make findings and ~ecommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: l. That the proposed use is properly one for which a Conditional Use Perr~t is authorized by ~ode Section 18.34,050.020, to permit a board and care facili y for senior cit?zens. 2. That the proposed use wili not adversely affect tlie adjoining land us!s and the growth and development of the area in which it is proposed to be lo.:ated. 3. That the size and shape of the site proposed for the use is adequate to allow the full development of the proposed use in a manner not detrimental tc the particular area nor to the peace, health, safety and gener~31 welfare of the Citizens of the City of Anaheim. 4. That the granting of the Co~ditional Use Permit under the conditions imposed, ff any, will not be detrimental to the peace, health, safety and gena:ral welfare of the Citizens of the ~ity of Anaheim. 5. That the petitionPr stipulated to a maximum of six (6) residents pius. one (1) housekeeping couple. 6. That there was no one in opposition to subject petition. ENVIRONMENTAL IMPACT REPORT FINDING: The Girector of Development Services has determined that the proposed activity falls within the definition of Section 3•O1, Class 1 of clie City of Anaheim Guidelines to the Reyuirements for an Environmental Impact Report and is, therefore, categorically exempt from the requirement to file an EIR. NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby grant subJect Petition for Conditional Use Permit, upon the followF g conditions which are hereby fou~d tn be a necessary prerequisite to the propose'~ use of the subject property in order to preserve the safety and general welfarc of the Citizens of the Gity of Anaheim: 1. That the existing structure s.hall be brought up to the minimum standan s of the Ci[y of Anaheim, including the Uniform Buiiding, Plumbing, Electrical, Housing, Mechanical and Fire Codes as adopted by the City of Anaheim. RESOLUTION N0. PC75-89 ..,, ; ~ ~ ~ 2. That trash storage areas shall be provided in accordance with aPproved plans on file with the office of the Director of Public Works. 3. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibit No. l. 4. That Condition Nos. 1, 2 and 3, above-mentioned, shall be compliad with prior to final building and zoning inspections. 5• That the use is limited to a maximum of six (6) residents plus one (1} couple for housekeeping duties, as stipulated to by the petitioner; provided, however, that if the petitioner wishes to increase the number of residents to ten (!0) plus one (1) housekeeping couple, a written request for such an increase shall be submitted to the Planning Commission for review and approval; subject property shall then be occ~epied solely by the board and care facility with no rental of units as multiple-family residences, and the buiiding shall comply with the fire code as may be required for the increased occupant load.
