A°ESOLJTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM
THAT PETITION FOR CONDITIONAL USE PERMIT N0. 1531 BE GRANTED.
WHEREAS, the City Planning Commission of the City of Anaheim did receive a
verified Petition for Conditional Use Permit from WILLIAM KUGEL, 551 North
Euclid Street, Anaheim, California 9z801 (Owner); LAIRO D. AhD DOROTHY i.
HOSKINS, 1224 West Park Avenue, Anaheim, Ca. 92801 (Agent) of certain real
property situated in the City of Anaheim, Counly of Orange, State of California,
described as Lot No. 70 of Tract No. 2517 as recorded in Book 133> Pages 40-42
of Miscellaneous Maps in the office of the County Recorder of said county; and
WHEREAS, the City Planning Commission did hold a public hearing at the City
Hall in the City of Anaheim on April 2E, 1975, at 1:30 p.m., notice of said
public hearing having been duly given as required by law and in accordance with
the provisions of the Anaheim Municipal Code, Chapter 18.03, *.o hear and consider
evidence for and against said proposed conditional use permit and to investigate
and make findings and recommendations in connection therewith; said public liear-
ing having been continued to the Planning Conimission meeting of May 12, 1975; and
WHEREAS, said Commission, after due inspection, investigation and study made
by itself and in its behalf, and after due consideration of ali evidence and
reports offered at said hearing, does find and determine the following facts:
l. That the proposed use is properly one for which a conditional use permit is ~
authorized by Code Section 18.44.050.010, to wit: permit on•sale beer in a card room.
2. That the petitioner stipulated that the primary use is a card room and not a ~
beer bar and, further, that there will be no stools provided for seating at the
service co:mter. °'-~,
3. That the Planning Commission determined that the subject use shall be
granted subject to no person(s) under 21 years of age being admitted to the establish-
ment, as stipulated to by the petitioner. •
4. That the proposed use as granted will not adversely affect the adjoining land
uses and the growth and development of the area in which it is proposed to be located.
5. That the size and shape of the site proposed for the use as granted is
adequate to allow the full development of the pr~iposed use in a manner not detrimental
to the particular area nor to the peace~, health, safety, and general welfare of the
Citizens of the City of Anaheim.
6. That the Conditional Use Permit, as granted and under the conditions imposed,
will not be detrimental to the peace, health, safety, and general welfare of the
Citizens of the City of Anaheim.
7, That no one indicated their presence at said public hearing in opposition, . t
and no correspandence aias received in opposition to subject petition. ~
ENUIRONMENTAL IMPACT REPORT FINDING:
That the Director of the Development Services Department has determined that the
proposed activity falls within the definition of Section 3.01, Cla~s l, of the City of
An~he.im Guidelines to the Requirements for an Environmental Impact Report and is,
the're`ore, categorically exempt from the requirement to file an EIR.
NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does
he~eby grant subject Petition for Conditional Use Permit, upon the following conditions
which are hereby found to be a nzcessary prerequisite to the proposed use of the subject
prcperty in order to preserve the safety and general welfare of the Citi2ens of the City
of Anaheim:
1. That subject property shall be developed substantially in accordance with
plans and specifications on file with the City of knaheim marked Exhibit NQS. ], 2,
and 3.

2. That the primary use of the sub,ject property shall be for a card room and
not a beer bar, and no stools for seating purposes shall be provided at the service
counter (bar1, as stipulated to by the petitioner.
3. That no person(s) under 21 years of age shall be admitted to the subject
establishment, as stipulated to by ~he petitioner.
