PC75-98 A RESOLUTION OF THE CITY PLANNING COMt41S510N OF THE CiTY OF ANAHEIM RECOMMENDING TO THE CITY COUNCIL OF THE CITY OF ANAHElM THAT PETITION FOR RECLASSIFICATION N0. 74-75-32 BE APPROVED. WHEREAS, the City Planning Commission of the City of Anaheim did receive a verified Petition for ?etlassification from DAVID S. COLLINS, 1077 West Ball Road, Anaheim, California 92802 (Owner); LEONAFD SMITH, 125-D South Claudina Street, Anaheim, California 92805 (Agent) of certain real property situated in the CiCy of Anaheim, County of Orange, State of California, described as: Parcel 2 as shown on a parcel map filed in Book 36 Page 24 of Parcel Maps in the office of the County Recorder of said county. EXCEPT any portion thereof included within the land described in a deed to Wilshire Woods Inc., recorded March 27, 1975 in Book 11365 Page 821, official records. AND EXCEPTIN6 the Easterly 5 feet of the'~'esterly 35 feet of that portion of Lot 35 of Anaheim Extension, as said lot is shown on a map of survey by William Hamel, a copy of which is shown in Book 3, Page 163 and 164 oF "Los Angeles County Maps", in the office of the County Recorder of said Orange County, to- gether with that portion of the Southeast 1/4 of the S~uthwest 1/4 of Section 9, Township 4 South, Range 10 West, as shown on a map recorded in Book 51, Page 10, Miscellaneous Maps, records of said Orange County, described as follows: Beginning at the intersection on the South line ef said Section 9~ with the Southerly prolongation of the Westerly line of Tract 5444, as per map recorded in Book 210, Page 28 and 29 of Miscellaneous Maps of said Orange County; thence Northerly 82II.85 feet along said Southerly prolongation, the Westerly line of said Tract 544~ and the Northerly prolongation of the Westerly line of said Tract 5444 to the Southeast corner of Lot 5 of the Anaheim Homestead Tract, as per map thereof recorded in Book 26 Page 10, Miscellaneous Records of Los Angeles County, California; thence Westerly 616.02 feet along the South line of said Lot 5 and the South line of said Anaheim Hanestead Tract; thence South 829.17 feet to the South line of said Section; thence East 618.82 feet to the point of beginning. EXCEPTING THEREFROM any portion thereof lying Southerly of the Northerly line of Wilshire Avenue as no~a shown of record. ALSO EXCEPTI4G the Northerly 260 feet thereof; and WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim on May 12, 1975, at 1:30 p.m., notice of said pu6lic hearing having been duly given as required by law and in accordance with Lhe provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed reclassification and to investi- gate and make findings and recommendetions in co~nection therewith; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following fac.ts: 1. That the pe~itioner proposes reclassification of the above-described property from tfie Rs-A-43,000 {RESIDENTIAL/AGR4CllLTIlRAL) to the RM-120~ (RESIDENTIAL, MULTIPLE-FAMILY) ZONE. 2. Tliat the Anaheim General Plan designates the subject property for commercial-professional uses; however, an RM-1200 apartment project was approved to the north of subject property, said property also having been designated for commerc9al-professional uses. hE50LUTI0N N0. PC75-91~ ~ ~ ~ 3. That the proposed rectassification of subject property is necessary and/or desirable for the orderly and proper development of the community. 4. That the proposed reclassification of subject prooerty does properly relate to the zones aAd their permitted uses locally established in close proximity to subject property and to the zones and their permitted uses generally established throughout the community. 5• That the proposed reclassitication of subject property requires the dedication and improveinent of abutting streets in accordance with the Circulation Element of the General Plan, due to the anticipated increase in traffic which will be generated by the intensification of land use. 6. That one (1) person, representing the property owner to the north, appeared at said public hearing in opposition, and also presented a letter in opposition. ENVIRONMENTAL IMPACT REPORT FINDING: That the Planning Commission recommends to the City Council that the subject project be exempt from the requirement to prepare an Environmental Impact Report, pursuant to the provisions of the California Environmental Quality Act. NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby recommend to the City Council of the City of Anaheim that subject Petition for Reclassification be approved and, by so doing, that Title 18-Zoning of the Anaheim Municipal Code be amended to exclude the above-described property from the RS-A-43,000 (RESIDENTIAL/AGRICULTURAL) ZONE and to incorporate said described proFerty into the RM-1200 (RESIDENTIAL, MULTIPLE-FAMILY) ZONE upon the following conditions which are hereby found to be a necessary prerequisite to the proposed use of subject property in order to preserve the safety and general welfare of the Citizens of the City of Anaheim: 1. That sidewatks shall be installed along Pearl Street and Wilshire Avenue as required by the City Engineer and in accordance with standard plans and specifications on file in the office of the City Engineer. 2. That street lighting facilities atong Wtlshire Avenue shall be installed as required by the Director of Public Utilities, and in accordance with standard plans and specifications on file in the office of the Director of Pubiic Utilities, and that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installation of the above-mentioned require- ments. 3. Tha~ the owner(s) of subject property shall pay to the City of Anaheim the sum of 60t per front foot along Pearl Street and Wilshire Avenue for tree planting purposes. 4. That trash storage areas shall be provided in accordance with approved plans on file with the office of the Diractor of Public Works. 5. That fire hydrants shall be.installed and charged as required and deter- mined to be necessary by the Chief of the Fire Department prior to commencement of structural framing. 6. That subject property shall be served by underground utilities. 7. That d~ainage of subject property shall be disposed of in a manner satisfactory to the City Engineer. 8. That the owner(s) of subject property shall pay to the City of Nraheim the appropriate park and recreation in-lieu fees as determined to be appropr?ate by the City Council, said fees to be paid at the time the building parmit is issued. 9. That the access ramps shall.be designed in accordance with the City of Anaheim Standard Detail No. 121. -2- RESOLUTION N0. PC75-98 ~ ~ 10. That appropriate water assessment fees as determined by the Director of Public Utilities shall be paid to the City of Anaheim prior to the issuance of a building permit. 11. Prior to the introduction of an ordinance rezoning subject property, Condition Nos. 2 and 3, above-mentioned, shall be completed. The provisions or rights granted by this resolution shall become null and void by action of the City Council unless said conditiors are complied with within one year from the date hereof, or such further time as the City Council may grant. 12. That Condition Nos. 1, 4, 6, 7 and 9, above-mentioned, shall be complied with prior to final building and zoning inspections. 1975.
