evidence for and against said proposed reclassification and to investigate and make
findings and recommendations in connection therewith; and

1, That the petitioner pronoses a reclassification of the ahove-described

5000 (RESIUEt~TIAL, SIPlGLE-FAMILY) ZOfJ[.
2, That the Anaheim General Plan designates subject property fcr a
combination of ned9um-density residential and commercial land uses.

and/or desirable for the orderly and oroper development of the communit.y.

by the Anaheim City Plannin~ Commission and evidence, both viritten and oral, having
been presented to su~plenent said draft EIR No, 163, th'e Planning Cor~mission
believes that said draft EIR f~o. lf3 does conforr~ to the i.ity and State Guidelines
and the State of California Environmental Quality Act and, based unon such
information, does hereby recommend to the City Council that the certify said EIF iJo.
163 is in compliance v~itli said Environmental Quality Act.
(IOIJ, TIiEFEFORE, DE IT RESOLVEU that the Anaheim City Plannin~ Commission
does herety rAcommend to the City Council of the City of Anaheir~ that subject
Petitinn `or Reclassification be ap~+roved and, by so doing, that Title 1~-Zoninn nf
the Anaheim "tunicipal Code be amended to exclude the above-described nroperty from
the CL (C0~•1~tE,~CIAL, LIIIITEU) and CH (COFFIERCIAL,HEAVY) ZOf1ES and to incorporate said
described property into the ftS-5000 (RESIDEPdTIAL, SIPIGLE-FA°1ILY) ZOtIE unon the
following conditions which are hereby found to be a necessary prerenuisite to the
pronosed use of subject property in order to ~reserve th~ safety and ~eneral ~.oelfare
of the Ci ti zens of tlie i.i ty of Analieim:
1. That all engineeriny requirements of the City of Anaheim, aloni Crov~ther
Avenue and Kraem~r Qoulevard including preparation of improvement plans and
installation of all in~provements such as curbs and gutters, sidewalks, scr~et grading
and paving, drainage facilities, or other appurtenant work shall be comolied ~aith as
required by the City Engineer and in accordance ~aith standard nlans and
specifications on file in the office of the City Engineer; that street lightin9
facilities alon9 Crowther Avenue, Kraemer Boulevard and Orangethorne Avenue shall be
installed as required by the Uirector of Public Util9ties, and in accordance with
standard plans and specif3cations on file in the Office of the Director of Public
Utilities and L:;at a bond in an amount and form satisfactory to the City of Anaheim
shall be posted with the Clty to 9uarantee the installation of the above-mentioned
requirements.
2. That side~•~alks sha11 be installed alnng Orangethorpe Avenue as required
by the City Engineer and in accordance viith standard plans and specifications on file
in the office of the City Fngineer.
3, That the owner(s) of subject nroperty shall pay t~ the City of Anahrim
the sum of 6Q cents per front foot a]ong Cro~~ther Avenue, Kraemer poulevard and
Orangethorpe Avenue for tree planting nurposes.
4. That fire hydrants sliail be installed and charqed as required and
determined to be necessary by the Chief of the Fire Department prior to commencement
of structural framing.
5. That subject property sha11 be served by underground utilities.
6. That drainage of sub~ect property shall be disposed of in a Manner
satisfactory to the City En9ineer.
7. That tfie oviner(s) of sub~ect oroperty sha13 oay to the Cit,y of Anaheim
the appropriate park and recreation in-lieu fees as determined to be anorooriate by
tiie City Council, said fees to be paid at the time the buildinq nermit is issued.
8, That a final tract map of sub~ect pronerty shall be submitted to and
approved by the City Council and then be recorded in the off9ce of the Oran~e County
Recorder.
9, That completion of these reclessification proceedings is continqent uoon
the 9ranting of Variance No. 2771.
10. Prior to the introduction of an ordinance rezoning subject pr~perty,
Condition Nos. 1 and 3, above-mentioned, shall be comnleted. The provisions or
rights granted by this resolution shall become null and void by actior of the City
Council unless said conditions are complied with within one year from the date
hereof, er such further time as the City Council nay grant.
