WHEREAS, the City Ptanning Commission did hold a public hearing at the City
Ilall in the City of Anaheim on August 2, 1~75, at 1:3~ p.m., notice of said public
hearin9 having been d~ly given as requtred by law and in accorclance with the
provisions of the Anaheim Municipal Code, Chapter 48.~3, to hear and consicler
evidence for and against saic! proposed reclaseiftcation and to investigate and make
findings and recommendations in connection therewith; and
WIIEREAS, said Commission, after due inspection, investi9ation and study made
by itsclf and in its behalf, and after duc consideratiun of all evidence and reports
cffered at said hearing, does find and determine the rollo~oing facts:
1, Th:~t the petitioner proposes a reclassification of the above-described
property from tl~e RS-A-~i3,onn (RESIDf:FlTIAL/AGRICULTUP,l1L) ZONE to the CL (COMHERLIAL,
LIHITffI) Z~tIF.
?. That although the Anaheim General Plan (as ~menrled in connectlon with
General Plan Amenrlment No, l;ii) designates sub,ject property for medium density
residential lancl uses, the proposeJ zoninn is deemed to 6e appropriate at the subject
locati~n, and appr~priate action will be taken to reflect the change in the land use
policy of th~: Anahein 6eneral Plan.
3. That the proposed reclassification of subject property is necessary
and/or desirable for the or~lerly and proper development of the community.
~i. That the proposed reclassificatio~ of subJect property does properly
relate to ~he ~ones and their permitted uses locally established in close proximlty

5, That the proposed reclassification of subject property requires the

generated by ttie intensification of land use.

npposition; anef no corres~ondence was received in oppoSiCion to sublect petition.

hr_reby recommend to the City Council of the City o~` Anahein L•hat the su~ject project
be exer~t from the requirement to prepare an environmental impact report, pursuant to
the provisi~ns of the Calif~rnia Environmental Quality Act.

r~n~.a, THE~F.F:1R[, BE IT RF.SQLUF.D that the An~heim City Pla~niny Commission
does hereby recomrrnci t~ the City Council of the City of Anaheim that subject
Petition for Reclassification be approvecl and, by so doinn, that Title Ir-Zoning of
the Anaheim Municipal Cocie he amen~iecl to exclude the above-described property from
the RS-A-~i3,0~~ (RFSIDE~IT~~L/Af,RICL'LTURAL) ZOI~E and to incorporate said described
property into the CL (L0~1!1CRCIAL, LIMITF.D) ZOtlE upon the following conditions which
are hereby found to be a necessary prPrequisite to the proposed use of subject
propcrty in order to preserve the safety and general welfare of the Citizens of the
City of Anaheim:
i, That t~ie awner(s) of subject property shall deed to the City of Anaheim
a strip of land thirty-two (32) feet in width f`rom the centerline of the street along
Romneya Drive for street oiidenin~l purposes.
2, That all enoineerin~ requirements oP the City of Anaheim along Romneya
Drive includin~ preparation of inprovement ~lans and installation of all
irnprovements such as curbs and 9uttere,, sidewalks, street gradir.g and paving,
drainage facilities or other appurtenant wurk, shall be complied with as required by
tliE City fngineer and in accordance with standard plans and specifications on file in
the Office of the City Engineer; that street lighting facilities along Romneya Drive
shall be installed as required by the Director of Public Utilities, and in accordance
with standard plans an~! specifications on file in the Office of the Director of
Public Utilities; or that a bond, certificate of deposit, letter of credit, or cash,
in an amount and form satisfactory to the City of Anaheim shall be posted with the
City to ~uarantee the installation of the above-mentioned requireicents.
,i, That the oomer(s) of subJect property shall pay to the Lity of Anaheim
the sum of sixty cents (6~~) per front foot along Romneya Drive for tree planting
purp~ses.
q, That trash storage areas shall be provided in accordance with approved
plans on file with the Office of tlie Director of Public Works.
5, That fire hydrints shall be installed and charaed as required and
determined to be necessary by tlie Chief of the fire Department prior to commer,cement
of structural framinc~.
6. That subjecC property shall be served by underaround uttlities.
7, That a six (6) foot masonry wall shall be constructed along the west
property line.
o. That cirainane of subject property shall be disposed of in a manner
satisfactory to the City Engineer.
9. 7hat apprapriate water assessment fees as determired by the D~irector of
Publir. Utilities sfiall be paid to the City of Anaheim prior to the issuance of a
building permit.
~p, That any parking area lighting shall be down-IighCing ar.d directed away
from the properr,y lines to protect nearby residential uses.
11. That subject property shall be developed substantially in accordance
~aith plans and specifications on file with the City of Anaheim marked Exhibit No. 1.
12, Prior to the introduction of an ordinance raezoning subject property,
Conciition Nos. 1, 2, and 3, above-mentioned, shall be comple[ed. The provis(ons or
riahts qranted by this resolution shall become null and void by action of the City
Council unless said conditions are compited with within one year from the date
hereof, or such further time as the City Council may grant.
13, That Condition tlos. 4, 6~ 7, S, 1~ and 11, above-mentioned, shalt be
complied with priar to final building and zoninq inspections.
