41HEREAS, the Anaheim City Planning Commission did rer.eive a verified

Beach, California 90855 (Agent) of certain real property situated in the City of

WIIERF.AS, the City Planning Commission did h~ld a puhlic hearing at the Ctty
Hall in the City of Anaheim on August 7., 1?76, at 1:30 P•m., notice of said public
hearing having heen duly given as required by law and in accordanc.=_ with the
provisions of the Anaheim Municipal Code, Cnapter 18.03, to hear and consider
evidence For and against said proroseJ variance and to tnvestigate and make finrlings
and recommendations in connecti~n therewith; and
WHEREAS, said Commission, after due inspecti~n, investigati~n and study made
by itself and in its behalf, and after due tonsideration of all evidence and reports
offered at saici hearing, does find and determine the following facts:
1, That the petitioner proposes the following waiver from the Anaheim
Municipal Code, to construct a medical/dental office complex in the 14L (ItlDUSTRIAL,
LIt41TED) ZOtJE:
SECTIO!! 18.G1.Q20 - Permitted uses. (Medical/denCal ofi`ice compiex
with auxiliary medical service not permitted)
2. That the petitioner did not demonstrate that a hardship would be
created if said waiver to establish a commercial use in an industrial area was not
granted.
3. That the traffic from the use proposed would conflict with the
industrial traffic in the area, and, therefore, will be incompatible with the
surrounding industrial area.
4. That the proposed use is not primarfly to serve the industrial
community, but is for the medical and den;al care of approximately 7.5,000 persons who
will be enrolled in group plans for service at tiie subjer.t location.
5, That there are no exceptfonal or extraordinary circumstances or
conditions applicable to the property involved or to the intended use of the property
that do not apply generally to the property or class of use in the same vicinity and
zone.
6. That the requested variance is not necessary for the preservation and
enJoyment of a substantial property right possessed by other property fn the same
vicinity and zone, anri denfed to the property in question.
7. That the requested variance will be ma:erially detrimental to the
public welfare or injurious to the property or improvements in such vicinity and zone
in which the property is located.
8. That no one indicated their presence at said public hearing in
opposition; and no correspondence was received in opposition to subject petition.

hereby recommenrl t~ the City Council of the City of Anaheim that the subJect project
be exempt fram the requirement to prepare an environmental impact report, pursuant to
the provisions of tl~e California Environmental Quality Nct.
PIQI~l, TIfF~~FORF, BE IT RESOLVFD that the Anaheim City Planning Commission
does hereby deny sub.ject Petition for Variance on the basis of the aforementioned
findings.
