evidence for and against said proposed varlance and to investigate and make findincis

continued to the Planning Cornmission meeti~g oF August 3~, 1976; and
WHEREAS, said Commission, after dug inspection, investigati~n and study made
by itself and in its behalf, and after ~iue consideration of all evidence and reoorts
offered at said hearing, does find and determine the following facts:
1. That the petitioner proposes the folloaiing waivers .`rom the Anaheim
Munlcipal Code, to construct four fourplexes:
a. SEf.TIQP! 1£3.34.061.020 - Mintmum buildtn site width. (70 fect
required; .~ feet and 3 eet proposed)
b. SECTI~N 1$.34.Q63.~17. - Minimum building setback.
c. SECTION 1A,34.Q63.021 - Mfnimum sideyard seCback.
d. SECTiON 18.3~.G65.011 - 111nimum distance between bulldings.
e. SEC710N iF.34.063.032 - Required recreational leisure area.
2. That ~'aiver 1-a, abo~de-me:r.tioned, is hereby grantP~i on the hasis of the
follov:ing findings:
a. That there are exceptional or extraordinary circumstances or
conditions applicable to the property involved or to the intended u<e, as granted, of
the property that do noC apply generally to the property or class of use i the same
vf~inity and zone.
b. That the requested variance, as granted, is necessary far che
preservation and enjoyment of a substantial property rtght oossessed by other
property in the same vicinity and zone, and denied to the property in question.
c. That Lhe requeste:i variance, as granted, will noC be materially
detrimental to the public welfare ar tnJuri~us to the property or improvements in
such vicinity and zone in which *_he property ts loceted.
3. That 4laivers 1-b, 1-c, 1-d, and 1-e, ahove-mentioned, are withdrawn by
the petitioner since revised plans were submitted which eliminated said waivers.
4. That no one indicaied their presence at said puhiic heartng in
opposition; and that no correspondence was received in opposition to subJect
petition.
ENVIRONHENTAL IMPACT REPORT FINDING: That the Anaheim City Planning
Commission does hereby recammend to the City Council of the City of Anaheim that the
subject project be e:cempt from the requirement to prepare an environmental impact
report, pursuant to the provisions of the Caltfornla Environmental Qualtty Act.

NOW, TNEREFQRE, BE IT RESOLVED that ehe Anaheim City Plannir.9 Canmission
does herehy grant, in part, subject Petition for Variance, upon the folloainq
conditions which are hereby found to be a necessary prerequisite to the pro;~osed use
of the s~bJect property in order to preserve the safety and general welfare of the
Citizens of the City of Anaheim:
1. That this Variance is granted suhJect to the cnmpletion of
Reclassification No. 7~-77-1Q~ now pendin9.
2. That subJect property shall be developed substa'ntially in accordance
with p{ans and specifications on file with the City of Anaheim mark.ed Revision ~lo. 1
of Exhibit tios. 1 through 6, and Fxhibit No. 7.
