IJHEREIIS, the City Planning Cc~mmission of the City of Anaheim did receive a
verified Petition for Variance from VII•lCEN7' C. GRAt~.T, 1~3979 Junelle Path IJ.,
Lakeville, I•linnesota 55044 (Owner); KEN VITATO, 1010 Marjan Street, Anaheim,
California 92a06 (Agent) of certain real property situated in the City of Anaheim,
- County of Orange, Stai:e of California described as:
Lot No. 50 of Tract IJo. 2121, in t~he City of Anaheim, as shoain in Book 60, Pages 23
and 24, ~4iscellaneous P1aps, records of Orange County Recorder.
4111EREAS, the City Plannin~ Commission did hold a public hearing at the City
Hall in the City of Anaheim on J.anuary 19, 197G, at 1:30 p.m., notice of said public
hearing having been duly give~ as required by laai and in accordance with the
provisions of the Anaheim hlunicipal Cod2, Chapter 18.Q3, to hear and consider
evidence for and against sai~ p-•oposed uariance and to investigate and make findings
and recommendations in connection therev~ith; and
Wii[REAS, said Commission, after due inspection, investigation and study made
by itself and in its behalf, and after due consideration of all evidence and reports
offered at said I~earing, does find and determine the following facts:
1. 7.hat the petitioner requests the folloti~~ing waiver from the Anaheim
F•1~~:~;cipal Code, to permit an unlawfully-established apartment addition to a single-
family dwelling:
SECTION 18.26.020 - Permitted uses. (apartments not
permitted in the RS-7200 Zone ~
2. That the apartment addition is not for family use by the principal
resident of the subject property, but is a separate rental unit.
3. That the apartment is substandard in that the floor area is
approximately 300 square feet ~~~hiie the zoning code requires a minimum floor area of
700 square feet for one-bedroom units and, additionally, it has been Plarrning
Commission policy to permit minimum floor areas of 425 square feet for bachelor-ty~e
(efficiency) units.
n„ Tliat the subject property is part of an RS-7200 (residential, sio,~~le•
family) zone tract and is not appropriate for multiple-family uses.
5. That the petitioner did not demonstrate that a nardship would ~r•.
created if said waiver were not granted.
6, That there are no exceptional or extraordinary circustances o~ •
conditions applicable to the property involved or to the intended use of the property
that do not apply generally to the proparty or class of use in the same vicinity and
zone.
7. That the requested variance is not necessary for the preservation and
enjoyment of a substantial property right possessed by other property in the same
vicinit,Y and zone, and denied to the property in question.

public welfare or injurious to the property or improvements in such vicinity and zone
in which the property is located.
9. That one (1) person appearPd at said public hearing in opposition; and
no correspondence was received prior to the public hearing in opposition to the
subject petition.
