THAT PETITIQN FOR CQNDITIONAL USE PER!11T M0. 1638 6E f,RAMTED.
WHEREAS, che Anohelm City Planning Commission did receive a verified
Petition for Conditional Use Permit fran FiRST AMERICAN TRIIST COMPANY AND THOMAS P.
WALKER, 2855 E. Coas[ Highway, Corona del Ma~, f.altfornta 92625 (Owners); JEFFREY
SCOZZARO, ?100 'B' East Via Burton, Anaheim~ California 92006 (Agent) of cer~tain real
property situated in the City of Anaheim, County of Orange, State of California
described as:
That pcrtion of Lot 6~ South Placentia Tract No. 2 as per map recorded in book 5,
page 42 of Miscellaneous Maps in the off(ce of the County Recorder of said
cuunty, sha~n as Parcel 3 on a Map filed in book 54, page 39 of Parcel Maps in
the office of the County Recorder of said county.
WHEREAS, the City Planning Commission did hold a public hearfng at the City
Hall in the City of Anaheim on August 30, 1g76, at 1:30 p.m., notic~e of said puhiic
hearing having bsen duly given as required by law and in a~cordance with the
provisions of the F.naheim Municipal Code, Chapter 1A.03, to hear and consider
evidence for and against said proposed conditional use and to investigate and make
findings and recommendations in connection therewtth; and
Wt:EREAS, said Commission, after due inspection~ Invsstigatton and study made
by itself and in its bQhalf~ and a~ter due consideratlon of all evidence and reports
offered at said hearing, does find and determine the follo4ring facts:
1. Tha: the proposed use is properly one for which a condiCionaf use
permit is authorizad by Code Section 18.61.Q50,070. to wit: permit automobile
pai~ting anJ body repair in the Ml (INDIISTRIAI, LIPIITF.D) ZQNE.
2. That Lhe proposed use will not adversely affect the adJoininn land uses
and the growth and development of the area in which it is proposed tn be located.
3. That the size and shape of the site p~oposed for the use Is adequate to
allow the f~ll development of the proposed use in a manner• not detrimental to the
particular area nor to the peace, health, safety, and general wetfare of the Citizens
of the City of Anaheim.
1~, That the granting of the Conditional Use Permtt under the conditions
imposed wtll not be detrtmental to the peace, health~ safety and general welfare of
the Citizens of the City of Anaheim.
5. That no one indicated their presence at said publtc heariny in
opposition; and 2hat no correspondence was received in opposttion to subJect
petition.
ENVfRONMENTAI IMPACT REPORT FItJDING: That the Director of the Planni~g
De~artment ha•~ determined that the proposed acttvity falls within the definitlun of
Section 3.01, Class 1, of the City of Anaheim Guidelines to the Requirements f~r an
En'vironmental Irnpact Report and is, therefore, categorically exempt fran the
requirement to file an EIR.
NOW, THEREFORE, BE IT RESOLVED that the Anahelm City Planning Commission
does hereby grant subJect Petitton for Conditlonal Use Permit, upon the following
conditions which are hereby found to be a necessary ~+rerequisite to the proposed use
of the subJect property in order to preserve the safety and general welfare of the
Citizens of the City of Anaheim:
1. That street lighting facilities along 1.'la Burton shatl be installed as
required by the Director of Public Utilitles and f~ accordance with standard
speclfications on file in the Office of the Director of Public Utillties, and/or that
a bond. certificate of deposlt, tetter of credit~ or cash; in an amount and form
satisfactory to the Clty of Anaheim shal~ he posted with the City *_~ guar:!~:t-e the
installation of the above-mentioned requirements.
2. That sub)ect property shall be devetoped substanttaily in accordance
wich plans and specificattons on flle ~.~ith the City of Anaheim marked Exhiblt Nos. 1
and 2.

3. That Conditton No. 1, 3':ave-menttoned~ shdio he complied with prPor to
the ~ommencement of the activity authori~ed under this resalution, or prior to the
time that the buildtnq permit fs issued, or within a pertod of one year frrxn date
hereof, whichever occurs first, or such further ttme as the Planning Cortmtssion may
grant.
4. That Conditio~i No. 2, above-mentioned, shall be complied with prior to
final building and zontng inspections.
5. That no outdoor automobile repair work or painttng shall be conducted
and there shall be no outdooi• storage of vehicles on the subJect property.
