RESOLU?ION OF THE ANAHEIM CITY PLANNING COMMISSION
THAT PETITION FOk VARIANCE N0. 2844 BE GRANTED.
WHEREAS, the Anaheim Cfty Plannin~ Commission did recelve a verified
°etltion for Variance from NQWARD AND HELEN GlLMORE, 527 N. Rose StrPet, Anahetm,
Californla 9zao5 (Owners); GENE AND ~JOROTIIY KANNARD 811 W. Sycamore Street, ~~aheim,
Califarnla 928b5 (A9ents) of cnrtaln real property situated in the City of Anaheim,
County of Orange, State of Callfornla described as:
Lots 1 and 2 in Block "A" of Tract No. 158, in the City of Anahelm, as shown on a
Map r~:corded ln Book 12, Pa9e 8 of Mlscellaneous Maps~ records of said Qrange
County.
EXCEPTING 7f1EREFROM, the Westerly 5•Z5 g~ct 'thereof, as conveyed to the City of
Anahelm~ for widening North Lcs Angeles Street, by deed recorded December 2,
1937, in Book 919, Page 207, Officlal Records.
'dHEREAS~ the City Planning Commisslon did hold a public hearing at the City
Hall ln the City of Anaheim on September 27, 19)6, at 1:3~ p.m., notice of said
public h-aring having been duly glven as required by law and in accord3nce with the
provi3lons of the Anaheln~ Municinal Code, Chapter 18,93, to hear and constder
evldence for and agatnst sriu pr~apesed variance and to lnvestigate and make findings
and recortanendations 1~ conne:tiar~ th::r~with; and
'JHEREAS. said Commi.<.aion, afier due inspection, investigai?nn and study made
by itself and in its behaif, and sSrrr due consideration of all evidence and reports
offered at said hearTng, does find and dttermine the following facts:
1, That the petitloner proposes the following o~aiver from the P.naheim
Municipal Code, to estahllsh a radiator and autanobile repair shop in the CG
(COMMERCI.4L, f,ENERAL) ZONE:
SECTION 1$,45.020 - Permltted uses. (Radiator and autc~mobile
~~ repa r work not permitted),
2. That the above-mee~tloned walver is hereby granted on the basis that the
oetitioner stipulated to r~movirvg the two (2) existing canopies and pump islands
within six (6) month:s from the effectlvc datc of this resolution.
;. That the petitloner further stipulated to removing the westernn~ost
driveway un North Street and the northernmost driveway on Anaheim Boulevard a~d
replacing same with landscaping and standard curb and gutter.
!i, That there are exceptlonal or extraordlnary circumstances or condiCtons
applicabte to the property lnvolved ar to the intended use o1' the property thaC do
not apply generally to the property or class of use tn tine same vicinitiy and z~~:~.
;, Thnt the requested varianc: is necessary for the prescrvation and
enJoymcnt of a substantial property right pos:ossed by other property in the same
vicinity and zone, and denled to the property ~n question.

pubtic welfare or inJurious to the propcrty or improvements in such vicinity and zone
in which the property is located,
7. That one (t) person appeared at sald public hearing in o~i~osition and
withdrew thc '+pposition on the basis that the petitfoner indicated the present
location of Lhc automobile repalr facillty will be reduced In denslty by the
relocatlon of on+e of the tenants to subJect property; and that no correspondence was
recelved in oppos~tion to the subject petitlon,
ENVIRONMENYi~L IMPACT REPORT FINDING: That the Director of the Planning
Department has dctermrr,ed that the proposed activity f;.lls within the definitton of
Section 3.01, Class 1, ~^~` the City of Anaheim Guidetines to the Requlrements foP an
Environmental Impacr R::port and is, therefore, categorically exempt from th~
requirement to file an F.IR.

NOW~ 7HEREFORE, BE IT RESOLVED that the Anahelm City Planning Cortmission
dces hereby grant subJect Petition for Varlance, upon the folloaring condttions which
are hereby found to be a necessary prerequtsite to the proposed use of the subJect
property in order to preserve the safety and general welfare of the Citizens of the
City of Anahelm:
1. That the westernmost driveway on North Street and the northernmost
drfveway on Anahetm Boulevard shall be removed and replaced wlth standard curb and
gutter and landscaping~ ~s stipulated to by the petitioner,
2. Th~t the u„dergrour.d gasollne storage tanks shall either be removed or
fllled as reguired anG approved by the City of Anahelm Fire Department.
3. That trash st~rage areas shall be provided in accordance with approved
plans on File wlth the Office of the Director of Public Works.
h. That subJect property shall be developed substantiatly in accordance
wfth plane. and specifications on file with the City oi' Anaheim marked Exhibit No. t;
provided, however~ that the two (2) exlsting canoples and pump islands shall be
removed within six (6) months from the effectlve date of thls resotution, as
stipulated to by the petitioner.
5. That Conditlon Nos. i through ~+, above-mentioned, sha41 be complied
with p:lor to final bullding and zaning Inspections,
