THAT PETITION FOR VARIANCE N0, 2860 BE DENIED.
WHEREAS, the Anaheim City Planning Commisslon did receive a verified
Petitlon for Variance from DEW CONSTRUCTION COMPANY~ tNC.~ 1157 N, f,rove, Anahelm,
California 92807 (Owner); OMEGA BOATS~ INC., 4540 E. La Palma Avenue. Anahelm,
Californla 92807 (Agent) of cerxaln real property situated in the City of Anahelm,
County af Orange~.State of CalTfornla described as:

Hall In the City of Anahelm on October 27, 1976, at 1s30 p.m., notice of satd publTc
hearing having been duly gfven as required by law and in accordance with the
provislans of the Anahelm Municlpai Code, Chapter 18.Q3~ to hear and consider
evidence for and agelns2 sald proposed vartance and to investigate and make t'indings
and recommendations ~n connectlon therewith; and
WHEREAS, sald Commisslon, after due Inspectton, Investigetian and study madc
by itself and I~ its behalf, end after due considaration of a11 evtdence and .reports
oPfered at sald hearing~ docs find and determine the following factss
1. That tho petitloner proposes the }oltowing waive~s from the Anahelm
Municipal Codc,~ to permit the ~utdoor storage of boats:
a. SECTION 18.61.063.011 - Mtnimum front setback, (Boet starage not

2. That the above-mentloned waivers are hereby denled on the basis that
the intent of the Anaheim Municipal Code pertelning to the storage of products
menufactured on the premtses ls to prohibit such outdoor storage In the front setback
adJacent to public streets; that the petitioner did not demonstrate that a hardship
wouid be created if said welvers were not grented; and that epprovel of the proposat
would sot an undnsirable precedent for future e~milar requests 1n tha industrlal
arees o4 Anahnim.
3, That there are na oxcepttonal or extPaordinary elrcumstances or
conditlons appllcabie to the property involved or to the intended use of the property
that do not apply genarally to the property or cless of use In the same vicin?ty and
zone.
4. That the requested varianc~ Is not necessary for the preservation and
enJoyment o4 a substan41a1 property right possessed by othe~ property in the same
victnity and zone, and dnnled to the property In question.
5. That the requested varlance will be materlally detrimental to the
pubiic welfare or in]urinus to the property or improvements in such vlcinity and zone
in which the property is loeeted,
6. Thet no one oppeared at sald public hearing in oppositlon; however, two
(2) lettars were received in oppositlon to the subJcct petitlon.

NOW~ THEREFORE~ BE IT RESOIVED that the Anahelm Clty Planntng Commission
doe~ bereby deny subJeet Petition for Varianee on the basis of the aforementioned
findings.
