WI~EREAS, the City Planning Commission did scheriule a public hearinn ~t the
City liall in the City of Anaheim on January 19, 197G, at 1:3Q ~.m., notice of said
public liearing having been duly given as required by lari ancl in accordance r~ith the
provisions of the Anaheim ~~unicipal Code, Chapter 18.Q3, to hear and consider
evidence for and against said proposed reclassification and to investigate and make
findings and recommendations in connection therewith; said public hearinq having been
continued to the Planning Commission meetinq of February 1~3, 1976; and
WHEREAS, said Commission, after due inspection, investigation and study
made by itself and in its behalf, and after due consideration nf all evidence .and
reports offered at said liearin~i, does find and determine the follo~~~ing facts:
1. That tlie petitioner pronoses a reclassification of the above-described

2. That the Anaheim General Plan designates the subject orooert,y for
general cornmercial and/or nedium density residential uses.

4. That the proposed reclassification of subject nronerty does nrnnerl,y
relate to the zones and their permitted uses locally established in close nroxim9ty
to subject property and to tlie zones and their permitted uses generally established
througf~out the comr.wnity.
5. That one (1) person appeared at said public hearing in nn~osition; and
no correspondence was received in opposition to sub~ect netition.

That the Ar~ahein City Planning Commission does hereby recnmmend to the City
Council that tihe sub;ect project be exempt fror~ the re~~irement tn nrenare an
environnental impact report, pursuant to the provisions of the California
Environr~ental Quality Act.

tdOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission
does hereby recommend to the City Council of tlie City of Anaheim that subject
Petition `or Reclassificat.ion be approved and, by so doinq, that Title 1R-Zoninn of
the Ariaheim Diunicipal Code be amended to exclude the above-descrihed oroperty from
the CL (COhiMERCIAL, LIt4ITEU) ZONE and to incorporate said described ~rooerty into the
FM-1200 (RESIDEtITIAL, i1ULTIPLE-FAttILYI ZOPIE upon the following conditions which are
here~y found to be a neces~ary prerequisite to the pronosed use of subiect pronerty
in order to preserve the safety and general welfare of the Citiz~ns of the Cit.Y of
Anaheim:
1. That fire liydrants shall be installed and charged as reauired and
determined to be necessary by the Chief of the Fire Department nriar ta cor~rnencement
of structural fram?ng.
2. That subject property shall be served by underground utilities.
3. Tliat drainage of subject nropertv shall be disposed of in a r~anner
satisfactory to the City Engineer.
4. Tliat the owner(s) of subject pronerty shall oay to the City of Ana{ieim
the appropriate park and recreation in-lieu fees, as determined to be appro~riate by
the City Council, said fees to be paid at the time the building permit is issued.
,. That, in accordance a~ith Council Policy No. 54'L, the oroperty o~~mer
shall provide a sound barrier adjacent to Lincoln Avenue, said barrier to be capable
of reducing the sound of motor vehicles to a max9mum of 55 dD CtJEL at any ~oint fi
feet above ground level in all exterior areas other tlian drivevrays, carnorts, and
parking areas. The residential st~•i~c~cures shall be designed to limi~ tl~e interior
noise caused by motor vehicles to a maximum of 4S d6 C~dEL, on an annual basis, in any
habitable room with windows elosed.
