^oulevard~ Anahcim, California 928~6 (Agent) of certain real property sttuated in the

Hall in Lhe City of Anahetm on November 22~ 5976~ at 1s30 p.m „ notlce of sald publlc
hearing having been duly given as requlred by law and in accordance wlth the
~ravlsions of the Anahoim Munielpal Code, Chapter 18.03, to hear and con~ider
evidence for and egainst said proposed conditiona) use and to i~vestigate and make
findings and recommendatlons In connection therewYth; and
WHEREAS, sald Commisslon, atter due insPectlon~ lnvestigation and study made
by itself and ln its behaif, and after due consideratTon of all evidence and reports
offered at sald heartng, does flnd and determine the follawing facts:
1. That the praposed use Is properly one for which a cbnditlonal use
permit Is authorized by Code Section 1$.26.050.020~ to wit: expand an exlsting child
nursery.
2. That the proposal is hereby granted, subJect r.o the stipulation of the
petltloner that a maximum of sixty {60) children wlll be cared for on the premises at
any one time.
3. That the Planning Commission does hereby deem it approprlate that the
petitioner reques2, ln wrtting~ that those persons pl~~ing up and delivering the
nursery children do so wlthout using the alley abutting the west praperty line; and
that a copy of said request be placed on file with the Planning Department.
4. That the proposed use will not advcrsely affect the ad)otning land uses
and the growth and develnpment of the area in whlch i± is proposed to be located.
5. That the slze and shape of the slte proposed for the use Is adequate to
allow the fult development of the proposed use in a manner not detrlmental to zne
parttcular area nor to the peace,~health, safety, and ger.>ral welfare of the Citizens
of the City of Anahelm.
6, That che granting of the Condltlonal Use Permit under the conditions
imposed wi11 not be detrimental to the peace~ health~ safety and gener~l welfare of
the Citizens of the City of Anaheim.

that no correspondence wes recelved in oppositlon to the subJect petition.

Environncntal Qualliy Act.
NQW, THEREFORE, BE IT RESDLVED that the ~naheim City Planning Commisston
does.here:+y grant subJect Petition far Condit?~nal Use Permit, upon the following
conditions which are hereby found to bo a necessary prerequlsite to Che proposed use
of the subJect property in orde- to preserve the safety and general welfare of the
Citlzens of th~ City of ^~~ahelm:
? That the owner(s) of subJect property shall deed to the City of Anaheim
a~:;ip of~land 53 feet in Nidth from the centerline of the street along La Palma
Avenue for street widening purposes.
2. That trash storage areas shall be provided.ln accordance with approved
~lans on file with the Dffice of the Director of Public Works.
3. That approprlate water asstssment fees, as determined by the Director
of Public UtilitTes, shall be pald to the Ctty of AnaheTm prtor to the issuancr of a
building permit.
4. That subJect ~property shall be developed substantislly In accordance
with plans and spzciflcations on flle with the Clty of Anahr,im marked Exhibit Nos, 1
and 2.
5. That Condition No. 1~ above-mentioned, shall be complled with prior to
the commencement of the activity authorized under this resolution, or prtor to the
tlme that the ouilding permit le Iss~ed, or withtn a period of one year from date
hereof, whichever occurs first~ or such further time as the Planning Commisslon
and/or City Council may grant.
6, Th~,t Condition Nos. 2 and 4, abave-mentioned~ shall be complied with
prior to final building and zoning Inspections.
7. That this conditlonal use permit is g~anted for a maximum of sixty (60)
children to be cared for on the premises at any one time~ as stipulated to .by the
petiEloner.
8, That the pe[itloner shall request, in wrtting, that all persons picktng
up and dellvering the nursery chlldren at the subJect location do so wlthout using
the alley abutting the west property lTne, a copy of said wrTtten reques"t to be
placed on flle ~viih the Flanning Department.
