TIiAT PETITIOFI FOR CONDiTIONAL USE PERMIT N0. 1671 BE GRANTED
41HEREAS, the Anaheim City Planning Cortmission did receive a verified
Petition for Conditional Use Permit from WILLIAM R. AND BARf3ARA L. WHITLAr Route 4,
Box A-27, Greensburg, Louisiana 70441 (Owners) and JOAN BIGHEAD, 851-1/2 South 5tate
Loltege Boulevard, Anaheim, California 92805 (Agent) .of certatn real .property
situated in the City of Anahelm, County of Orange, State of California, described as:
The South 222.0 feet of the West one-half of the Southwest Quarter of the
Soutnoiest Quarter of the Southeast Quarter of Section 2~ Tow~ship h South, Range
10 West, in the Rancho San Juan CaJon d~ Santa Ana, as shown on a Map recorded in
Book 51, page 10 of t4iscellaneous Maps, records of Orange County, California.
EXCEPT therefrom the interest in the West 10.0 feet thereof conveyed to the City
of Anaheim by deeds recorded July 19, 1954 in Book 2772, pages 582 and 603 of
Offici'al Records of said Orange Cou~ty.
WHEREAS, the City Planning Commission did hold a publtc hearing at the City
I~all in the City cr AnaRieim on December 6, 1976; at 1:30 p.m., notice of said public
hearing having bePn duly given as required by law and in accordance with the
provisions of the A~aahelm Municipal Code, Chapter 18.03, to hear and consider
evidence for .and against said proposed conJitional use and to investigate and make
flndings 'and recomnendations in connection therewith; and
WIIEREAS, 5~31d Commission, after d~e inspection, investigation and study made
by itself and in its behalf, and after due consideration of all evidence and repurts
offered at said hearing, does find and determine,the following facts:
•t. That the proposed use is properly one for which a conditional use
permit is authorized by Municipal Code Sectien 18.44.050.010, to wit: permit on-sale
Ueer and wine.in an e;cisting restaurant in the CL (Commercial, Limited) Zone.
2. That the proposed use ts hereby granted for a period of two years,
subJect to review and consideration for posstble time extensions. "
3, That th~ petitioner stipulatP~ that the hours of operat.ion will be from
10:00 a.m, to 9:00 p.m. ~ •
~. That the petitioner stipulated that the sale of beer and wine will be
in conJunction with the serving of ineals only.
5, That the propcsed uss, as granted, will not ~adversely affect the
adJointng land uses and the growth and developme~t of the are.a :n which ir. is
proposed to be locaCed. .
6.. That the size and slia~e of the site proposed for the use is adequate to
allow the full development of the proposed use, as granted, in a manner not
detrimental to ~the particular area nor to the peace, hea',~th, safety, and general
welfare of the Citizens of the City of Anaheim.
7. That the Condttional Use Permit, as granted and under +the condttions
impased, will not be detrimentai to the peace, health, safety, and general welfare ~f
the Citizens of the City of Anaheim.
8. That no one indicate~i their presence at said public hearing in
opposition; and that no correspcndence was received in oppositlon to the subJect
petition.

NOW, THEREFORE, BE IT RESOLVED that the Analhaim City Planning Commission
does hereby grant subJect Petltion for Conditional Use f'ermit, upon the following
cor~d;tlons which are herety faund to be a necessarjr prerequtsite to the.proposed use
cf the subJect p~operty in~order to preserve the safety and general welfare of the
Cieizens of the C(ty of Anaheim:
1. That subjeet property shall be developed substantially in accordance
with plans and specifications on ffle with the City of Anaheim marked Exhibit Nos. 1
and 2; provided, hovtever, that the landscaped planters adJacent to La Palma Avenue
and Acacia SCreet shall be adequately maintained, in .accordance wi.th Code, as
stipulated to by the petitioner,
2. That this condltionai use permit shali be granted for a period of two
(2) years, subject to rev'ew and consideratio~ for possible time extensions by the
Planning Comnisslon. upon written request by the p=titioner.
3. That the sale of beer and wine shall be in con;unction with the serving
of ineals only. as stipulated to by the petition~r.
4. That the hours of operation shall be from~10:00 a.m. to 9:00 p.m., as
