'dItEREAS, the City Planning Commission did hold a public hearinn at the City
Hall in the City of Anahelm on December 2~, 1976, at 1:3~ p.m., notice of said puhlic
hParing having been duly glven as required by la~o and In accordance with the
provisions of the Analielm Municipal Code, Chapter 18.03, to hear and consider
evidence for and against said proposed conditional use and to investigate and make
findings and recommenc~ations in connection tF~erea~ith; and •
1•1fiEREAS, said Commission, after due inspectlon, investigation and study rnade
by itself and in its behalf, and after due c~nsideration of all evide~ce and reports
oifered at said hearing, does find and determine the following facts:

permit is authorized hy Munici~~al Code Section 18,44.050.010, to •o!it: permit the
expansion of an existing cocktail lounge with araiver of:

2. ThaY the above-mentioned waiver is herehy granted, in part, on the
basis that the petitioner stipulated to p.rovidir~; :~n ~odditional 14 parking spaces,

that, if the need arose, petltionar indilr< ~'. ~d:iitional area f~r parking was
availa~le; and, furthermore, the petitira~er 'fed that d~ring th~ peak operating

closed.
3. That the proposal is an expansfon of an existing cocktail lounae whfch
has not been detrimental to the area.
4. That the proposed use, as granted, will not adversely afifect the
adjoining land uses and the growth and development of the area in which It is
proposed to be located.
5. That the size and shape of the site proposed for the use, as granted.
is adequate to allow the full development of thc proposed use in a manner not
detrimental to the particular area nor to the peace, health, safety, and general
welfare of the Citizens of the Ctty of Anaheim.
6. That the Conditional Use Permit, as granted, and under the conditions
imposed, will not be detrimental to the peace, fiealtfi, safety and qeneral v!elfare of
the Citizens of the City of Anaheim.
7. That no one indicated their •presence at said public hearing in
opposft?on; and that no corres~ondence a~as recelved in opposition to subject
petition.
ENVIRONMENTAL IHPACT REPOftT FINDING: That the Director of the PlanninG
Department has determined that the proposed acttvity falls within the definttion of
Section 3.01, Class 1, of the ~ity of Anaheim Guideiines to the Requlrements for an

Environmental Impact Report and is, thereforE, categorically exempt from the
requirement to file an EIR.
NQlJ, THEREFORE, BE IT RESQLI~ED that the Anaheim Ctty Planning Gommission
does hereby grant, in part, subJect Petition for Conditional Use Permit, upon the
foliowing conditions which are hereby found to be a necessary prerequisite to the
proposed use of the sub.ject property in ordar to preserve the safety and general
welfare of the Citizens of the City of Anahelm:
1. That this Conditional Use Permit is granted subJect to completion of
Reclassification No. 63-6~+-118, prior to the issuance of buildlr,a permits.
2. That trash storage areas shall he provtdPd in accordanr.e with aoproved
plans on file with tfie Office of tiie Director of Puhlic 4lorks.
3. That any building permits for existisig and/or proposeJ construction be
obtained from the Building Division, and that an inspection hy Building Dlvision
stafP be made prlor to the commencement csf the activity authorized under tF.is
resolution, or within a period of ninety (90) days from the date of approval,
whichever occu-s first,
4. That sub.ject property shall be developed suhstantially in accordance
o-~ith plans and specifications on file ~oith the City of Anaheim marked Exhihit t~os. t
through 4; provided, however, that f~urteen (ih) additionai parV:ing spaces shall bc
provided and all extsting and proposed parking spaces shall be surfaced and marked in
accordance o~ith Code requirements.
5. That Conditlon Nos. 1 and 3_, above-mentioned, shall be complied with
prior to final building and zoning inspections.
