WIiEREAS, the City Planning Commission did hold a public hearing at Ch.e City
Hall in the Lity of Anaheim on December 22~ 1975, at 1:30 p.m., notice of said pub•lic
hearing having been duly 91ven as required •by law and in accordance with ~he
provisions of the Anaheim Municipai Code, Chapter 18.03, to hear and Eortsider
evidence for and against said proposed variance and to investigate and make fin4,:ni~;
and recommendatians in connection therewith; said publlc hearing having bee.n
conttnued to the Planning Lommission meeting of March 29, 1~7fi; and
WHEREAS, said Commission, after due inspection, investigation and study i:i3de
by itself and in its behalf, and after due consideration of all evidence and reports
offered at said hearing, does find and determine the following facts:
1. That the petitioner requests the following waiver from the Anaheim
Municipal Code, to construct a bank in the ML (INDUSTRIAL, I~MITED) 20NE:
SECTION 18.61.020 - Permitted uses. (Dank n_t a permitted use)
2. That the above-mentioned waiver is hereby granted on the basis that ths
petitioner indicated a maJor portion of the bank's business would be with small
industrial establishments in the area.
3. That the petitioner stipulated that the service station site located at
the southwest corner of subject property shall meet the minimum site development
standards of the Gity of Anaheim as pertains to service stations.
4. That there are excepttonal or extraordinary circumstances or conditions
applicable to :he property tnvolved or to the intended use of the property that do
~ot apply generalty.to the property or class of use in the same vicinity and zone.
5. Tliat the requested variance is necessary for the preservation and
enjoyment of a substantial property right possessed by other property in the same
vicinity and zone, and denied to the property in question.
6. That the requested variance will not be materially detrimental to the
public welfare or inJurious to the property or improvements in such vicinity and zone
in which the property is located.
7. That no ene indicated their presence at said puhlic hearing in
opposition; and no correspondence was received in opposition to subJect petition.
ENVIRONMENTAL IMPACT REPORT FItVDING:
That the Anaheim City Planning Commission does hereby recommend to the City
Council that the subJect proJect be exempt from the requirement to prepare an
environmental tmpact report. pursuant to the provisions of the Lalifornia
Environmental Qualtty Act.
NOW, THEREFORF, BE (T RESOLVED that the Anaheim City Planning Commission
does hereby grant subject Petition for Variance, upon the foliowing co,:ditions which
are hereby found to be a necessary prerequisite to the proposed use of the subJect
property in order to preserve the safety and general welfare of the Citizens of the
City of•Anaheim:

1. That the~ner(s) of subject property sha~deed to the City of AnahPim
a strip of land 32 feet (total width of 6Jo feet) along the propossd new street for
street construction purposes.
2. That the owner(s) of subJect property shall conditionally dedicate to
the City of Anaheim a strip of land along State College Boulevard for the future
construction of a gra~~e separation sr.ructure at the ATsSF Railroad, the ~•~idth of
which shall be determined by the City Engineer, conditioned upon the construction of
the grade separation and the City's need for the additional right-of-way.
3, That all engineering requirements of the City of Anaheim, along State
Coilege Boulevard, Katella Avenue and the proposed new street, including preparatiun
of improvement plans and installation of all improvements such as curbs and gutters,
sidewalks, street grading and paving, drainage facilities, or other appurtenant work,
shall be complied with as requirod by the City Engineer and in accordance r~ith
standard plans and specifications on file in the Office of the City Engineer; that
stree*_ lighting facilities along the proposed new street shall be installed, as
required by the Director of Public Utilities, and in accordance with standard plans
and specifications on file in the Office of the Director of Public Utilities or that
a bond in an amount and form satisfactory to the City of Analieim shall be posted with
the City to guarantee the installation of the abave-mentioned requirements.
4. That the owner(s) of subJect property shall pay to the City of Anaheim
the sum of $2.00 per front foot along State College Boulevard and Katella Avenue for
stre~et !ighting purposes.
5, That trash storage areas shall be provided in accordar.ce with approved
plans on file with the office of the Director of Public Works.
6. That fire hydrants shall be installed and charged as required and
determined to be necessary by the Chief of the Fire Departme~t prior to commencement
of structural framing.
7, That subject property shall be served by underground utilities.
8. That drainage of subJect property shall be disposed of in a manner
satisfactory to the City Engineer.
9. In the event that subJect property is to be divided for the purpose of
sale, lease or financing, a parcel map to record the approved divisTon of subject
property shall be submitted to and approved by the City of Anaheim and then be
recorded in the Office of the Orange County Recorder.
10. That the vehicular access rights to State College Boulevard, except at
approved access points, shall be dedicated to the City of Anaheim.
11. That appropriate water assessment fees as determined by the Director nf
Public Utilities shall be paid to the City of Anaheim prior to the issuance of a
building permit.
12, That subject property shall be developed substantialiy in accordance
with plans and specifications on file wlth the City of Anaheim marked Exhibit No. 1
(Revision No. 1); provided, however, that the service station site at the southoiest
corner of subject property shall meet the minimum site development standards of the
City of Anaheim, as stipulated to by the petitioner.
13. That Condition Nos. 1, 2, 3, 1~, and 10, above-mentioned, shall be
complied with prior to the commencement of the activity authortzed under this
resolution, or prior to the time that the building permit is issued, or ~ithin a
period of one year from date hereof, whichever occurs first, or such furt~er ti~e as
the Planning Commissio~ and/or City Council may grant.
14. That Condition Nos. 5, 7, 8, and 12. above-mentioned, sha11 he complied
with prior to final building and zoning inspections.
