PC 76-63~ ~ RESOLUTION N0. PC76-63 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM THAT PETITION FOR VARIANLE N0. 27~13 4E GRAN7ED. WfIEREAS. the City Planning Commission of the City of Aneheim did initiate a verified Petition for Variance on certain real property situated in the City of Anaheim, County of Orange, State of Caiifornia described as: Lot Nos. 16 and 17 of Tract No. 3343, in the City of Anaheim, as shown in Book i02, Pages 47 and 48, Miscellaneous Maps, Records of Orange County. WHEREAS, the City Planning Commission did schedule a public hearing at the City Hall in the City of Anaheim on March 1, 1976, at 1:30 p.m., notice of said public hearing having been duly given as required by lavr and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed varianc~ and to investigate and make fi,ndings and rec.aromendations in connection therewith; said publ(c hearing having been cc,ntinued to the Planning Commission meeting of April 12, 1976; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due constderation of all evidence and reports offered at said heartng, does find and determine the following facts: 1. That the Rnaheim City Planning Commission proposes the foliowing waiver from the Anaheim Municipal Code, to permit the continued use of commercial offices in the RM-1200 Zone: SECTION 18.34.020 - Permitted uses. (Office uses not permitted in the RM-1200 Zone) 2. That the above-mentioned weiver is hereby granted on the basis that subJect property is currently being uttlized for offices and a hardship would be created for the property owner(s) if said waiver were not granted perr~itting the continuation of said use; provided, however, that said waiver is granted for the existing businesses only, unless~ otherwise approved by the Planning Commission or City Councll. 3, That thera are exceptional or extraordinary circumstances or conditions applicable to the property involved or to the intended use~ as granted, of the property that do not apply generaliy to the property or class of use in~the same vicinity and zone. 4. That the requested variance, as granted, is necessary for the preservation and enJoyment of a substantial property right possessed by other property in the same vicinity and zone~ and denied to the property in question. 5. That the requested variance, as granted, will not be materially detrtmental to the public welfare or injurious to the property or improvements in such vicinity and zone in.which the property is lecated. 6. That no one indicated their presence at said public hearing in opposition; and no correspondence was received in opposition to subJect petition. ENVIRONMENTAL IMPACT REPORT FINDING: That the Director of the Planning Department has determined that the proposed activity falls within the definition of Section 3.01, Class 1, of the City of Anaheim Guidelines to the•Requirements for an Environmental impact Report and is, therefore, categorically exempt from the requirement 2o file an EIR. NOW. TNEREFORE, BE lT RESOLVED that the Anaheim City Planning Commission does hereby grant subJect Petition for Variance~ upon the following conditions which are hereby found to be a necessary prerequisite to the proposed use of the subJect property in order to preserve the safety and generat welfare of the Cltizens of the City of Anaheim: ~~ 1. That this variance is granted to permit the existtng commercial office uses ( Information Research" at 2119 West Ball Road, "Robert W. Hardin" at 2127 West Ball Road~ and "Cotter Institute of Hy~osts" at 2131-A West Ball Road) to contlnue on the subJect property; provided, however, that when the present office use of the RESOLUTION N0. PC76-63 ~ ~ property ceases, the applicable u~its shall revert to residential usage and this variance shall then become null and void on the affected portion of the property, unless otherwise approved by the Planning Commisston or City Councit.
