IdHEREAS, the City Planning Co~r,mission did schedule a public hearin9 at the
City Hall in the City of Anahe~m on December 22, 1975, at 1:30 p.m., notice of said
public hear9ng having been duly given as required by la~-i and in accordance ~~~ith the
pravisions of the Anaheim Municipal Code, Chapter 18.03, to hear and con~ider
evidence for and against said proposed conditional use and to investigate and ~vake
findings and recommendations in c~nnection therewith; said public hearing having ~een
continued to the Planning Cnminissi~n meetirg of 3anuary 19, 1976.
WHEREAS, said ~ommission, after due inspection, investigation and study made
by itself and in its behalf, and after due consideration of all evidence and reports
offered at said hearing, does find and determine the `olloe~ing facts:
1. That the proposed use is properly one for which a conditional use
permit is authorized by Code Section 18.61.050.390 and 18.61.050.400, to wit: permit
a planned industrial complex ~~ith commercial uses and a restaurant in the ML
(IhJDUSTRIAL, LII4ITEU) ZOIJE.
2, That the petitioner stipulated to providing means of restrieting ~eft
turn vehicu~ar ingress and egress to the t~~bject property from Ka~ella Avenue;
provided, however, that said Means of restricting a.r.cess shall be subject to the
review and approval of the Traffic Engineer.
3, That the petitioner stipulated to constructing a planted median in
State College Boulevard.
4, That a privdte street, construc~ed in conformance with public street
standards, shall be provided on th~ northerly portion of the subject prooerty.

5. That the petitioner stipulated that the ~commercial uses of the subject
property i~~ill be restricted to specific uses, subject to the review and approval of
the Planning Department.
6. That the proposed use wili not adversely af;ect tha adjoining land uses
and the growth and development of the area in ~~ihich it proposed to be located.
7. That the size and shape of the site proposed for the use is adequate to
allow the full development of the proposed use in a manner not detrimental to the
particular area nor to the peace, health, safety, and general a~elfare of the Citizens
of the City of Anaheim.
~. That the granting of the Conditional Use Permit under the conditions
imposed, if any, will not be detrimental to the peace, health, safety, and general
welfare of the Cit9zens of the City of Anaheim.
9. That no one indicated their presence at said public hearing in
opposition; and no correspondence was received in opposition to subject petition.
ENVIROI~(dEIJTAL II•iPACT REPORT FINDINS:
Tiiat the Anaheim City Pl~anning Commission does hereby re::u~mnend to the City
Council of the City of Anaheim that the subject pro~act b~~ exempt from the
requirement to prepare an environmental impact report, pursuant to the provisions of
the California Environmental Quality Act.
N041, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission
does hereby grant subject Petition for Conditional Use Permit, upon the following
conditions which are hereby found to be a necessary prerequisite to the proposed use
of the subject property in order to prese~°ve the safety and genei•al ~aelfa~•e of the
Citizens of the City of Anaheim:
1. That the owner(s) of subject property shall deed to the City of Anaheim
a strip of land h5 feet in a~idth from the centerline of the street along Pacifico
Avenue for street widening purposes.
2. That all engineering requirements of the City of Anaheim along Pacifico
Avenue and State College Boulevard including preparation of improvement plans and
installation of all improvements such as curbs and gutters, sidewalks, street gradir.g
and paving, drainage facilities, or other appurtenant work, shall be complied ~aith as
required by the City Engineer and in accordance with standard plans and
specifications on file in the office of the City Engineer; that street lighting
facilities along Pacifico Avenue sha11 be installed as required by the Director af
Public Utilities and in accordance with standard pians and specifications on file in
the Office of the Director of Public Utilities; and that a bond in an amount and form
satisfactory to the City of Anaheim shall be posted with the City to guarantee the
installation of the above-mentiflned requirements.
3. That the owner(s) of subject property shall pay to the City 2f Anaheim
the sum of ~2.00 per front foot along Katella Avenue and State College Doulevard for
street lighting purposes.
4. That sidewalks shall be installed along Katella Avenue as required by
the City Engineer and in accordance ~~~ith standard plans and specifications on file in
the Office of the City Engineer.
5. That trash storage areas shall be provided in accordance with approved
plans on file with the Office of the Director of Public lJork~.
6. That fire hydrants shall be installed and charged as required and
determined to be necessary by the Chief of the fire Department prior to commencement
of structural framing.
That subject property shall be served by underground utilities.
8. That drainage of subject property sha11 be dispased of in a manner
satisfactory to the City Engineer.
9, Tn the event that subject property is to be divided for the purpose of
sale, lease or financing, a parcel map to record the approved division of subject
property shall be submitted to and approved by the City of Anaheim and then be
recorded in the Office of the Oranye ~ounty Recorder.

10. 7hat appropriate water assessmen~c fees as determined by the Director ot
Public Utilities sha11 be paid to the City of Anaheim prior to t"~ issWan~ce of a
build~ng permit.
il, That a 10-foot wide public ut~lity easement extending so~uther]y from
Pacifico Avenue to the southermost boundary of subject property shall be d~dicated to
the City of Anaheim, on an alignment subje~t to the approval of the Dir~ctor of the
Utilita~es Department.
12. That, as stipulated to by the petitioner, a planted median shall be
installed in State Coilege Boulevard, as required by the City Engineer and in
accordance with standard p'lans and specifi~ations on file in the Offfice ~of the City
Engineer; that reasonable landscaping, including irrigation faci~ities, shall be
installed in accordance with the rV,e}7sirements of the SupPrintendent of Parkway
I~aintenance; and that a bond in an am•.+.,r;t. and form satisfactory to the City of
Anaheim shall be posted with the w`:;:~ to guarantee the installation of the above-
mentioned requirement. Follo~~~9ng thr, installation and acceptance, the City of
Anaheim shall assume the responsibility for maintenance of said lanascaping.
13. That subject property shall be developed substantially in accordance
with plans and specifications on file with the City of Anaheim marked E:.:hib9t Mos. g
through 5; provided, hov+ever, that the location and number of all drive accesses to
Katella Avenue, Pacifico Avenue, and State College Boulevard shall be subjECt to the
r•eview and approval of the Traffic Engineer; that a private street constructed to
public street standards shal] be provided on the northerly parcel, and that the means
of restricting left turn vehicular ingress and egress from Katella Avenue shall also
be subject to the review and approval of the Traffic Engineer.
1~. That Condition tJos, 1, 2, 3, 9, 11, and 12, above-mentioned, shall be
complied ~•~'.:h prior to the commencement of the activity authorized under this
resolut:o:~, or prior to the time that the building permit is issued, or within a
period ~:r one year {rom date hereof, whichever, occurs first, or such further time as
the Pla;±ning Commission andlor City Council may grant.
15. That Condition ~~os. h, 5, 7, fi, and 13, above-mentioned, shall be
complied with prior to final building and zoning inspections.
16. That each use proposed io be established on subject preperiy, which i~
intended to qualify under Code Section 18.61.050.400, shall be submitted in written
form to the Planning Department for review and approval in order that a determination
may be nade as to whethe~ the proposed use would be appropriate for the site a~d
whether suffic?ent parking is provided on the property to accommodate an additiona7
parking demand created by such a use. In order te provide guidelines for staff
determination, the follo~~iing type of uses, as submitted by the petitiorer, may be
permitted subject to the written request and reviea~ procedure outlined above:
