WHEREAS, the City Plannin9 Commtssion did hold a puhlic hearing at the City
Hall in the City of Anaheim on April i2, 197Fi~ at 1:30 p.m., notice of said puhlic
hearing having been duly gtven as required hy laa~ and in accordance with the
provisions of the Anaheim ;lunicipal Code, Chapter 1L'.Q3, to hear and consider
evidence for and against said proposed conditional use and to investigate and make
findings and recommandations Yn connection there~vith; and

~~ WHEREAS, sald C~ission, after due inspection, ~estigatlon and study made
by itself and in its behalf, and after due consideration of all evidence and reports
offered at said heartng, does find and determtne the following facts:
i. That the proposed use is properly one for which a conditTonai use
permit is authorized by Code Section 18.44.050.010, to wlt: permlt "on~sale" beer
and wine in an existing restaurant.
2. That the petitloner indicated that beer and wine will be soid in
conJunction with the serving of ineals only.
3. That the proposed use o~ill not adversely affect the adJoining land uses
and the growth and development of the area in which it is proposed to be located.
4. That the size and shape of the site proposed for the use is adequate to
~llow the rull development of the proposed use in a manner not detrimental to the
particular area nor to the peace, health, safety, and general welfare of the Citizens
of the City of Anaheim.
5. That the granting of the Conditional Use Permit under the conditions
imposed, if any. will not be detrimental to the peace~ health. safety and general
welfare of the Citizens of the City of Anaheim.
6. That no one indicated their presence at said public hearing in
opposition; and no correspondence was received in opposition to subJect petition.
E4VIRONMENTAL IMPACT REPORT FINDiNG:
That the Director of the Planning Department has deee.rmined that the
proposed activity falis within the definition of Sectton 3.~1, Class i~ of the City
of Anaheim Guidelines to the Requirements for an Environmental Impact Report and is.
therefore, categorically exempt from the requirement to file an EIR.
NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission
does hereby grant subJect Petltion for Conditionat Use Permit, upon the following
conditions which are hereby found to be a necessary prere~uisite to the proposed use
of the subJect property in order to preserve the safety and general welfare of the
Citizens of the City of Anaheim:
1. That subJect property shall be developed substanttally in accordance
with plans and specifications on file with the City of Anaheim marked Exhibit Nos. 1
and 2.
2. That the beer and wine shall be sold tn conJunctlon with the serving of
meals only.
