A P.ESOLUTION OF THE CITY PLANNING COMMISSION OF TNE C17Y OF ANANEIM
TFiAT PETITION FOR VARIANCE N0. 2796 DE DENIED.
WHEREAS~ the City Planning Commisston of the City of AnaheTm did receive a
verified Petition from THOt1AS E. LAVENBERG~ 1108 N. Louise Drive~ Anaheim, Callfornia
92805 (Owner) of certain real property situated in the City of Anaheim. County of
Orange, State of California described as:
Lot No. 10 of iract No. 1515, in the City of Anaheim~ as shc~wn in Book 45, Page
41, Miscellaneous Maps, Records of Orange County.
WHEREAS, the City Planntn9 Commission did hold a pubiic hearPng at the City
Hall in the City of Anaheim on April 12, 1976, at 1:30 p.m.~ norice of said public
hearing having been duly given as required by law and in accordance Hith the
provisions oP the Anaheim Municipal Code, Chapter 18.03, to hear and eonsider
evidence for and against said proposed variance and to investigate and make findings
and recommendations in connection therewith; and
WHEREAS, said Commission, after due inspection, investigation and study made
by itself and in its behalf, and after due consideration of all evidence and reports
offered at said hearing, does flnd and determine the following facts:
1. That the petitioner requests the following waiver from the Anaheim
Municipal Code, to permit the raising of rabhits in the RS-7200 (RESIDENTIAL, SINGLE-
FAMILY) ZONE:
SECTION 18.02.052.0133 - Haximum number of rabbits
5 permitted; 40 proposed
2. That the above-mentioned waiver is hereby denied on the basis that
subject property which is a typical lot in a single-family residential tract is not
an appropriaYe location for the ralsing of rabbiCs, that a potenttal health hazard
exists, and that property owners in the surrounding area obJected to the proposal.
3. That there are no exceptional or extraordinary circumstances or
conditions applicable to the property involved or to the intended use of the properiy
that do not apply generally to the property or class of use in 'the same vicinity and
zone.
4. That the requesCed variance is not necessary for the preservation and
enjoyment of a substantial property right possessed by other property in the same
vicinity and >_one, and denied to the property in question.
5. That the requested variance will he materially detrimental to the
public welfare or inJurious to the property or improvements in such vTcinity and zone
in whi:h the property is located.
6. That two (2) persons appeared, represe~ting approximately sixteen (16)
persons present in opposition to subject petition; and that two petitions signed by
approximately sixty-five (65j property owners and residents tr, the surrounding area
in opposition were received.
ENVIRO'NMEN7AL IMPACT REPORT FINDINf:
That the Director of the Planning Department has determined that the
proposed activity falls within the definition of Section 3•~1, Class 1, of the City
of Anaheim Guidelines to the Requirements for an Environmental Impact Report and is,
therefore, categoricatly exempt from Yhe requirement to file an EIR.
NOW, THEREFORE, BE IT RESQLVED that the Anaheim City Plannir,g lammtssion
