WIiEREAS, the City Planning Commission did hold a puhlic hearing at the City
tlall in the ~ity of Anaheim on April 12, 1°7~, at 1:3n p,m., notice of said puhlic
hearing haviRg b~Fr duly given as requlred by la~a and in accordance with the
provisions of the Anaheim Hunicipal Code, Chapter lf~.(13, to hear and consider
evidence for and ag~inst saici propnsed variance ar.d to investigate and mal:e frndings
and recommendations in connecti~n there~oith; and
WHE'tEAS, said Commission, ~fter due inspc«ction, investigation and study made
by itself and in its behalf, and after due consideration of atl evidence and reports
offered at said hearing, does fin~i and determine the f~llowing facts:
1. That the ~+etitioner requests the following waiver from the Anaheim
Municipal Code, to expand an existing r~atel:
SECTION 13.(1f.~f.~.02h3 -'tinimum numher of ar~in s aces.

2. That the above-mentioned waiver is hereby granted on the basis .that the
Planning Commission acknowledges the fact that the suhject property is in the
Commerclal Recreation Zone and is in close proximtty to Disneyla~d and the Anaheim
Convention Center; and that it has been indicated hy previously submitted d~ta and
studies that approximately 2i1 percent of the visitors to said commercial recreation
area arrive by a transport~tion mo~fe other than private automohiles; and~
furthermore, that the petitioner submitted information to support tha requested
waiver, proposin9 an apProximately 1; percent reduction in the minimum number of
parking spaces required for a motel. .
3. That there are exce~tional or extraordinary circumstances or conditions
applicable to Lhe property involved or to the intended use of the property that do
not apply genera!ly to the property ~r class of use in the same vicinity and zone.
~~. That the requested variance is necessary for the preservatior and
enjoyment of a substantial property riaht possessed by other proFerty in the same
vicinity and zone, and denied to tfie pr~perty in c~uestion.
5. That the requested variance a+ill not be materiaily detrimental to the
puhiic r~elfare or inJurious to the property or imnrovements in such vicinity and zone
in which the proper:y is locate~l.
6. That no one indicated their presence at said puhlic heartnq in
opposition; and no correspondence ~•ias received in ooposltion to subJect petttton.

ENVIRONMENTAL IMPACT RIEPORT FINDING:
That the Anaheim City Plannin9 Commission does hereby recanmend to the City
Council that the subJect proJect be exempt from the requirement to prepare an
envtronmental impact report, pursuant to the provislons of the California
Environmental Quality Act.
NOW~ THEREFORE, BE IT RESQWFD that the Anaheim City Planning Comnission
does hereby grant subJect Petition for Varianee, upon the following condltions whieh
are hereby found to he a necessary prerequisite to the pro~osed use of the subJect
property in order to preserve the safety and general welfare of the Citizens of the
City of A~aheim:
1. That subJect property shall he developed substantlally in accordance
with plans and specifications on file with the City of Anaheim marked Exhibit ~los, i~
