City Flall in the City of Anaheim on December 22, 1975, at 1:30 p.m., notice of said
public hearing having been duly given as rer~uired by law and in accordance with the
provisions of the Anaheim tiunicipal Code, Chapter 1t3.03, tn hear and consider
evidence for and against said nroposed variance and to lnvestigate and ma{:e findings
and recommendat9ons in connection there~aith; said nubllc hear9nn having been
continued to the Plannin~ Commission meeting of January 19, 1976; and

by itself and in its behalf, and after due cunsideration of a11 ev9dence and renorts
offered at said hearing, does find and determine the Po1lowing facts:
1. That the petitioner requests the follor~ing waivers from the Anaheim
hlunicipal Code, to establish an office in the RS-7200 (RESIDFPlTIAL, SIiIGLE-FA'1ILY)
ZONE.

2. That waiver 1-a~, above-mentioned, is hereby granted for a time
limitation of two years, sub~ect to review and consideration for an extension of
time, upon written request by the petitioner, subject to the stipulation of the
petitioner that the property shail be for his nersonal office use onl,y and ne portion
of the property will be rented fcr use by others.
3. That waiver 1-b, above-mentio~ed, is hereby denied on the basis that ~
si9n larger than 1 square foot is not necessary since the pronerty is for the
petitioner's oa~n use and no advertisement to generate walk-in customers is permitted.
4. That the Planning Commission does hereby direct that an Area
Development Plan for the subject area be initiated in order that bY thr. end of the
time limitat~on granted for this variance the appropriateness of the use as a
permitted use in the area may be est.a~lished.
5. That there are exceptional ~r extraordinary circumstances or conditinns
a.pplicable to the property invulved or to the intended use of the property that do
not apply ~enerally to the property or class of use in the sam? vicinity and zone.
6. That the req~!ested variance is neces~ary for the ~reservatiorr and

vicinity and zone, and denied to the property in question.

Council of the City of Anaheim that the subject ~roiect be exempt fror~ the

requirement to nrepa~re an environmental i~pact renor~pursuant to the ~rovisions of
the California Environmental Quality Act.
NObI, TIIERfFO~E, BE IT RESOLVED that the Anaheim City Pianninq Commission
does hereby 9rant, in part, subject Petition for Variance, upon the follav~inq
c~nditions which are hereby ~'ound to be a necessary prerequisite to the pro~osed use
of the subject property in order to nreserve the safetY and ~eneral welfare of the
Ci ti zens •^f the Ci ty of Anaheim:
1, That the owner(s) of subject property shall deed to the City of Anafie9r,
a st~ip af land 53 feet in width from the centerline of the street along State
College fioulevard, including a 15~fout radius nronerty line return for street
widening purposes. ,
~, That the existinq structure shall be brou~ht un to the mininum
standards of the City of Analieim, including the Uniforr~ Building, Plumbin4~
Electrical, Iiousing, ~4echanical an:i Fire Codes, as adopted by the City~of Anaheim.
3. Tha~t sub~ect pro~ert,y shall be develnned substantiallY in accordance
with plans and specifications on file with tlie City of Anaheim marked txhibit ?~os. 1
and 2; provided, however, that the signing shail be in accordance with code
standards.
n,, That Condition IJo. 1, above-ment9oned, shall be comolied with pr9or to
the commencenent of tlie activity authorized under this resolution, or vrior to the
time that the building permit is issued, or within a oeriod of one year froro date
faereof, whichever occurs first, or such further time as the Planning Commission
and/or City Council may grant.
