THAT PETITION fOR CONDITIONAL USE PERMIT NO.1F20 8E GRANTED.
WHEREAS. the Anaheim City Planning Commission did receive a verified
Petitton for Conditional Use Permit from ARNOLD INVESTMENT COMPANY, 2293 W. Ball
Road, Anaheim, California 92804 (Owner); JOHN RU7HERFORD, 93~1 Oma Place, Carden
Grove, California 92641 (Agent) of certain real property situated in the City of
Anaheim, County of Orange, State of California described as:
PARCEL 1: The South 50.OD feet of that portion of the North 15 acres of the
Southeast quarter of the Southeast quarter of Section 18, Township 4 South, Range
10 West, in the Rancho Los Coyotes~ in the City of Anaheim, as said section is
shown on a map recorded in book 51, Page 10, Miscellaneous Maps, in the office of
the county recorder of said county, lying Easterly of the following described
line: '
Beginning at a point on the North line of sald North 15 acres, South 8A° 57' 4P"
West 401.30 feet from the Northeast corner of said North 15 acres; thence South
0° 02' 12" East 495.33 feet to the South line of said North 15 acres.
• WHEREAS, the City Planning Commission did hold a public hearing at the City
Hall in the City of Anaheim on May 1Q, 1976, at 1:30 p.m., notice of said public
hearing having been duly given as required by law and in accordance with tr~e
provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider
evidence for and against said proposed conditiona) use and to investigats and make
findings and recommendations in connection there~~ith; and
WHEREAS, said CoRr.nissio~, after due inspection, investigation and stucly made
by itself and in its belialf, and after due consideration of all evidence and reports
offered at said hearing, does find and determine the following facts:
1. That the proposed use is praperly one for which a conditional use
permit is authorized by Code Section 18.44.050.010, to a+it: permit on-sale liquor in
an existing restaurant.
2. That the proposed use wiSl not adversely affect the adjoining land uses
and the gra~th and development of the area in which it is proposed to ~e located.
;. That the size and shape of the site proposed for the use is adequate to
allow the full development of the proposed use in a manner not detrimental to the
particular area nor to the peace, health, safety. and general welfare of the Citizens
of the City of Anaheim.
!}. That the granting of rhe Condittonal Use Permit under the conditions
imposed, if any, will not be detrimental to the peace, health, safety and general
welfare of the Citizens of the City of Anaheim.
5. That no one indicated their presence at said public hearing in
opposition; and no correspondence was received in opposition to sub)ect petition~
ENVIRONMENTAL IMPACT REPORT FINOING:
That the Director of the Planning Department has determined that the
proposed activity falls a~ithin the definition of Section 3.01~ Class i, of the City
of Anaheim Guideltnes to the Requirements for an Environmental Impact Report and is,
therefore, categorically exempt from the requirement to file an EIR.
NOW, THEREFORE, BE lT RESOLVED that the Anah~im City Planntng Commission
does hereby grant subJect Petition for Conditional Use Permit, upon the following
condition which are hereby found to be a necessary prerequisite to the proposed use
of the subJect property in order to preserve the safety and general welfare af the
Citizens of the City of Anaheim:
1. That sub)ect property shall he developed substantially in accordance
wi2h plans and specifications on file with the City of Anaheim marked Exhibit Nos. 1
and 2.
