THAT PETITlON FOR VARIANCE i~0. 2933 BE GRANTED
WHER[AS, [he Anaheim City Pianning Lommission did receive a verified
Petition for Variance from JOt1t~ J. At~D t1ELEN L. LADIG, SR., 613 Eas[ Wilhelmina
Street, Anaheim, Caliiornia 92305, owners of certain real property situated in the
CiCy of Anaheim, County of Orange, State of California, described as:

Hall in the i.ity of Anaheim on May 23, 1977, at 1:3~ p.m., notice of said pubiic

provisions of the Anaheim Municipal vode, Chapter 18.03, to hear and consider
evidence for and against saici ~~r~c•r;-~ vari,3nce and to investiyate and make findings

WNEREAS, said Commissio, ; ,.~r d~+e inspection, investigat(on and study made
by itself and in ~ts behalf, an~1 ~~':.:~° d~e consideration of all evidence and reports
offered at said hearin9, does fincl and detcrmine the followiny facts:
1. Tha[ the petitioncr rce,uests a waiver of the f~llowing to permit an

2. That thc above-mentioned waiver is hereby granced on [he basis that the
request is minimal in tha[ only two conforming parking spa~es, both being enclosed in
a garage, are avallable on-site and ihe proposal also consists of two spaces, only
one being enclosed and the other being open; that the converted garage is
nonconforming as an enclosed parkiny space because the doorway Nidth is less (7 1/2
feet) than specified by [he Zoniny Code (9 feet) and, therefore, vehicular access and
usability for parktng purposes is difficult; and that because of the corner location,
the subject property has over 120 feet of street frontage and, therefore, ample on-
street parking (4 Co 5 spaces) is available in addition to the 2 on-site spaces.
3, That there are exceptional or extraordinary circumstances or conditlons
applicable to ttie property involveti or [o the intended use of ttie property that do
not apply yenerally to the property or class of use ln Che same vicini[y and zone.
4. That the requesteJ variance ts necessary for the preservation and
enjoyinent of a subs[antial property right possessed by other property in the same
vicinity and zone, and Jenied to the property in question.

5. That the requested variance will no[ be naterially detrimental to the
public welfare or injurieus to the property or improvements in such vicinity and zone
in which the property is located.
6. That no one indicated his presence at said public hearing 1n
opposition; and tha[ no correspondence was received in opposition to subject
oetitlon.
EI~VIRONMEt7TAL IMPACT FINUING: That the Dircctor of the Planning Depar[ment
has determined ~hat the propaspd aciivity falls within~ the defir~ition of Section
3.01, Class 1, of the Cit~~ of Anaheim Guidelines to thc Requirements for an
Environmental Impact Report and is, therefore, categorically exempt from the
requirernenC [o file an EIP,.
IJOW, TIIEREFORE, BE IT RESOLVEU that the Anaheim City Planning Commission
does hereby yrant subject Petition for Variance, upon the following condi[ions which
are hereby found to be a necessary prerequisite Co the proposed use of ttie subject
property in order to preserve the safety and general welfare of the Li[izens of the
City of Anahcim:
1. Tha[ the existiny structure shali be brought up to the minimum
standards af the Csty of Anaheim, including the Uniform f3uilding, Plumbing,
Electrical, Housing, Nechanical and Fire Codes as adopted by the City of AnaFeim, as
stipulated to by the petitioner.
2. Tli~t subject property shall be developed substantially in accordance
with plans and specificatio^s on file wi[h the Ci[y of Anaheim marked Exhibit t~o. 1.
3. That Condition t~os. 1 and 2, above-mentioned, stiall be complied w(th
prior to final building and zoning inspections.
