offered at said hearing, does find and deterr.iine the followiny facts:
1. That the petitioner proposes a waiver of thc followiny to establish a
45-lot, 44-unit RS-HS-22,0~0(SC) (RESiUENTiAL, SINGLE-FAMILY HILLSIUE-SCEP~IC COP,RIDOR
OVERLAY) ZOt~E subdivision:
SECTION 18.23.065•O10 - Re uirsment that all lots rear-on an arterial
highriay. One side-on lot propose~
2. That the abave-nentioned waiver is granted for a 44-lot,, !~3-un(t RS-f15-
22,000(SL) subdivision on the basis that the subiect propcrty has a minimal width of
approximacely 170 fec[ near Fairmont Sloulevard, and when thc proposal is developed, a
new public street will substantially reduce said ~•~iJth, nakiny it ir~possible to
establish a lot that aocs not front on eithcr the new public s[reet or Fairmont
6oulevard; and tlia[ frontiny-on the new public street and siding-on Fairmont
Boulevard is thc iwst desirable lot alignment because of the arterial highway
designation of Fairmont ttoulevard.
j, That there are exceptional ar exiraordinary circumstances or conditions
applicable to the property involved or [o the intended use of the property that do
not apply generally to Lhr_ property or class of use in the same vicinit~y and zone.
4, That tf~e requesteci variance is necessary for the pr~eservaCion and
enjoynent of a substantial proper[y rlylit possesscd by otfier property in tlie same
vicinity and zane, and denicd to [he propcr[y in question.
5. That thc requested variance will not be mater(ally detrimental to the
public welfare or injurious to tfie property or inprovemen[s in such vicinity and zone
in orhich the property is locateJ.
6. That three (3) persons indica[ed their presence a[ saiJ public hearing
in opposition and no correspondence oras received in opposition to thc subject
peti[ion.
EiIVIROt~t1El~T<~L IHPACT FIt~QI11G: Tha[ the Anaheirn City Ptanning Commission,
having considered Environmenta Impac[ Report No. 198 for the proposed dev~lopment of
44 lots on the 25.1 acres located approximately 2050 feet south oi the centerline of
San*.a Ana Ganyon P,oad, finds that (a) potenCial projec[-generated individual and
curaulative adverse Impacts have been reduced to an insignificant level due to the
equestrian-type estates, and (b) the subject E1R lio. 19a conforms to the City and

State Guidelines and thc State of C~lifornia Enviro~mental Quality Act and, based
upon the foreyoing inforn~tion, the Planniny Commission does here6y recortmend to the
City Council of the City of Anaheim that they certify saiJ EIP. Plo. 198 is in
compliance with said Environmental Quality Act. Copies of EIP. No. 198 are on file in
the Office of the Pianning Departrent.
1~04l, TfiEREFORE, 4E IT RESO~V[D that the Anaheim City Planning Commission
does fiereby grant subject Petiiion for Variance, upon the following conditions which
are hereby found to be a necessa:y p~erequisite to the pruposed use of Lhe subject
property in order to preservc the safety and gencral welfarc of the Citizens of the
City of Anahein:
1, That this Variance is yranted subject to the approval of Tentative Hap
of Tract tJo. 9721.
2, That [he ovmer(s) of subject propcrty shall deed to Lhe City of Anaheim
an casement for equestrian and hif:iny [rails as required by the Planning Commission,
said easement to be recorded concurrently Nitli the Final tract map.
j, That, in accordancc witti Council Policy Wo. 53s, a 40-foot building
setback shall be maintained on Lot N~. 1 of Tract No. 9721, unl~ss oLherwise waived
by the City Council.
4, That subject property shall be developed substantially in accordance
with plans and specifications on file with tfic City of Anatieim ~~wr4:ed ExhibiC h7o. 1.
5, That Condition No, l, abovc mentioned, shalt be complic:d with prior to
the commencement of the activity authorizeJ under this resolution, or prior to the
time [hat the buildiny permit is issued, or within a period of one year from date
hereof, whichever occurs first, or sucii further time as the Planning Commission
and/or City Council n~ay yrant.
6. That Conditiu~ tlos. 3 and 4, above mentioned, shall be complied with
prior to final builJing and zoniny inspections.
